HomeMy WebLinkAbout2011-9-7858 ORDINANCE NO. 2011 -9 -7858 AN ORDINANCE AMENDING SECTION 70 -5, AND SECTION 70 -94 OF CHAPTER 70, PARKS AND RECREATION OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 70 -5 is hereby amended to read as follows: Sec. 70 -5. Rules of conduct for recreational areas. The rules of conduct for recreational areas shall be as follows: (1) Alcohol is not allowed in any City of Paducah park facility. (2) Weapons are not allowed in any City of Paducah park. (3) (2) Soliciting or sale of material is not allowed in City of Paducah parks. (4) (3) Parking is not allowed on grass in City of Paducah parks. (5) (4) Do not nail signs to trees. (6) (5) Obey posted hours of operation. (7) (6) All dogs must be leashed and droppings picked up and disposed of in a waste receptacle when in City of Paducah parks. (8) (7) Place all trash in waste receptacles. (9) (8) Overnight stays are not allowed in a City of Paducah park. 4-0)- (9) Mechanical games, carnivals, or use of animals are not authorized in City of Paducah parks. (11) (10) If a public address system or other amplification of voice and/or music is used, sound must not extend beyond the perimeter of the facility being utilized. (12) (11) Ice skating is not allowed on Noble Park Lake. (13) (12) Personal watercraft are not allowed in Noble Park Lake. (-1-4) (13) Signs or banners cannot be hung from or on towers /front of Noble Park entrance. (15) (14) Permits for special events and/or nonconfoiining uses are the jurisdiction of the Parks Services Director. Organizers are responsible for securing permits for such use through the Paducah Parks Services office. (15) The City of Paducah Parks Services may permit for exclusive use shelters, athletic fields, buildings, facilities and/or specific zones of the park. Other park users may not interfere with the peiniitted use. (17) (16) The Parks Services Director is authorized to temporarily adjust or suspend park rules as required to serve public safety and /or program logistics. (-1-8) (17) The Parks Services Director is hereby authorized to adopt additional rules specific to each facility. Said rules shall be posted in a conspicuous place at the relevant facility and shall be followed as if fully set forth herein. SECTION 2. That Section 70 -94 is hereby amended to read as follows: "Sec. 70 -94. Rules and regulations. The following rules and regulations are to be made known to users of the skatepark. (1) Warning: The Paducah Skatepark is unsupervised. Users assume all risks inherent in the use of this facility. Use may result in serious injury up to and including death. (2) Know your abilities and skate at your own risk. (3) Minors should have parental supervision. (4) Only skateboards, roller skates, and bicycles are allowed in the skate area. (5) No motorized devices of any sort are allowed within the skatepark. (6) Users shall wear a protective helmet (by ordinance). Elbow, knee, and wrist pads are strongly encouraged. (7) Do not engage in reckless behavior (including, but not limited to, tandem riding, pushing, horseplay, fighting, and /or bullying), or any other activity that could endanger the safety of others. (8) No smoking, eating or drinking allowed within the fenced area. (9) No glass containers in the fenced area. (10) No alcohol or drugs permitted. (11) No firearms, knives or other weapons allowed. (12) (11) No items may be brought into the fenced area as obstacles, ramps or for any other purpose. (13) (12) Do not proceed into the skate area until it is clear of other users and /or any debris. (1-4) (13) Do not overcrowd the facility. (15) (14) Do not use the facility during or after bad weather. Certain weather conditions such as rain, snow or ice can adversely affect ramps and surface conditions. (-6 (15) No spectators inside the skating area. (17) (16) Skating is permitted during hours established by Parks Services Director. (17) No pets are allowed inside the fenced area. (1-9 (18) The Kentucky Recreational Use Statute (KRS 411.190) applies to the Paducah Skatepark. SECTION 3. That Ordinance Nos. 2007 -2 -7252 and 2006 -8 -7161 of the City of Paducah entitled, "AN ORDINANCE ADOPTING `RULES OF CONDUCT' FOR CITY RECREATIONAL AREAS PURSUANT TO CHAPTER 70, `PARKS AND RECREATION' OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY," and `AN ORDINANCE CREATING ARTICLE V OF CHAPTER 70 OF THE CITY OF PADUCAH CODE OF ORDINANCES AND THEREBY ESTABLISHING THE PADUCAH SKATEPARK AND RULES AND REGULATIONS FOR SAME," are hereby repealed. SECTION 4. That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City of Paducah hereby declares that it would have passed this ordinance, and each section, subsection, clause or phase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. ‘44111 May.r ATTEST: AL/ aka tAz-A Tammara S.
