HomeMy WebLinkAbout09/26/95403 SEPTEMBER 26, 1995 ROLL CALL At a Regular Meeting of the Board of Commissioners held in the Commission Chambers at City Hall at 7:00 p.m., Tuesday, September 26, 1995, Mayor Montgomery presided, and upon call of the roll by the City Clerk, the following answered to their names: Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery. MINUTES Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the reading of the Minutes for September 19, 1995, be waived and that the Minutes of said meeting prepared by the City Clerk be approved as written. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). SUSPEND ORDER OF BUSINESS Mayor Montgomery offered motion, seconded by Commissioner Coleman, that the Board suspend the order of business and discuss Agenda Item VI. C. at this time. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). (This item was the purchase of real estate from Petter Supply Company). ORDINANCE - INTRODUCTION PURCHASE PETTER PROPERTY Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH ROBERT P. PETTER, ET AL, IN THE AMOUNT OF $1,195,000 TO ACQUIRE VARIOUS PROPERTIES LOCATED ALONG SOUTH FIRST STREET, SOUTH SECOND STREET, AND KENTUCKY AVENUE, IN THE CITY OF PADUCAH, McCRACKEN COUNTY, KENTUCKY". This ordinance is summarized as follows: Authorizing the Mayor to enter into a contract with Robert P. Petter, et al, in the amount of $1,195,000 for purchase of the following properties in the City of Paducah: 117 South First Street, 117 and 121 Kentucky Avenue, 106, 108, 110, 112, 114, 116, 118 and 230 South Second Street, and to negotiate and enter into an option to purchase and/or right of first refusal of the property located at Second and Washington Streets, subject to Commission approval. *Dan Key, Assistant Corporation Counsel, discussed purchase of the Petter Property.and described the individual tracts to be purchased. He said the City's negotiated purchase price is below the property's appraised value. He hopes to have the final documents ready for next week's Commission Meeting. R & F DOCUMENTS Commissioner Grumley offered motion, seconded by Commissioner Hornsby, that the following documents be received and filed: 1. Performance and Payment Bond (a) Federal Materials Co. Inc. 2. Paducah Area Chamber of Commerce Government Contract for v Membership, executed by Jerry Hoover, City Manager 3. Contract with ODB for Three Ditch Cleaning Machines for ,r Public Works Dept/Street Division 4. Forest Hills Public Project Corporation Financial Report for May 31, 1995 and 1994 Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). MUNICIPAL ORDER 404 SEPTEMBER 26, 1995 PERSONNEL CHANGES Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that upon the recommendation of the City Manager, the Board of Commissioners of the City of Paducah orders that the personnel changes on the attached list be approved. (SEE MUNICIPAL ORDER BOOK) Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). ORDINANCES - ADOPTION: PURCHASE OFFICE VISION COMPUTER SOFTWARE Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING THE PURCHASE OF OFFICE VISION COMPUTER SOFTWARE FROM IBM CORPORATION FOR THE AS/400 COMPUTER SYSTEM IN THE AMOUNT OF $17,095.50, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME". ORDINANCE NO. 95-9-5369, BOOK 26, P. 33 JAIL LEASE TO McCRACKEN COUNTY Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE A MEMORANDUM OF LEASE BETWEEN THE CITY OF PADUCAH AND COUNTY OF McCRACKEN, KENTUCKY, FOR LEASE OF THE FORMER CITY JAIL FACILITIES, FOR USE AS A JUVENILE DETENTION CENTER". The foregoing title summarizes the contents of this ordinance. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). ORDINANCE NO. 95-9-5370, BOOK 26, P.33'1 ORDINANCE - INTRODUCTIONS CHANGE ORDER NO. 1 - NOBLE PARK TENNIS COURTS Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners introduce an ordinance ✓' entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE CHANGE ORDER NO. 1 IN THE AMOUNT OF $4,864.32 WITH CENTRAL PAVING OF PADUCAH INC. FOR NOBLE PARK TENNIS COURT RESURFACING". The foregoing title summarizes the contents of this ordinance. AMEND CIVIL SERVICE SEC. 10-55 Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING SECTION 10-55, CIVIL SERVICE, '� OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Abolishing the position of Flood Control Supervisor, and increasing the pay grade of Flood Control Superintendent to Grade 15 in the Department of Environmental and Engineering Services, Stormwater Management Division. REPEAL ORDINANCE NO. 95-6-5294 FOR ELEVATOR REPAIRS BY DOVER Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE REPEALING ORDINANCE NO. 95-6-5294, ENTITLED, "AN ORDINANCE ACCEPTING THE PROPOSAL OF DOVER ELEVATOR COMPANY IN AN AMOUNT NOT TO EXCEED $30,500 FOR REPAIRS TO THE CITY HALL ELEVATOR, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME". The foregoing title summarizes the contents of this ordinance. *City Manager Hoover explained that the City has been unable to finalize specifics to be included in a contract with Dover SEPTEMBER 26, 1995 Elevator for these repairs, and that the City has subsequently found that new evaluations reveal no emergency exists for these repairs. PROPOSED TAX RATE ADJUSTMENT (DECREASE) MAYOR MONTGOMERY discussed the proposed City tax rate decrease. Finance Director Jon Perkins handed out information and also discussed this decrease through the utilization of graphs and charts. This proposed tax cut will result in a $30,000 net loss in revenue without any future growth. A tax rate hearing is scheduled for October 3, 1995, at 7:00 p.m. i TRAFFIC RECONFIGURATION AT 17TH & JEFFERSON Steve Doolittle discussed traffic improvements at this location and presented possible options to improve conditions at this intersection. TRAFFIC AT 21st AND JEFFERSON At the request of Commissioner Renfro, Mr. Doolittle said an engineering study will be performed at the intersection of 21st and Jefferson. MAYOR MONTGOMERY thanked the Traffic Commission for the work they have done on intersections. MOTION TO PROCEED WITH TRAFFIC COMMISSION PROPOSAL Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Commission proceed with the Traffic Commission's proposal. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). This proposal includes the reconfiguration of traffic signs and the addition of an island median at the intersection. COMMISSIONER HORNSBY announced that Leadership 1995-96 classes have started. BUSINESS LICENSE FEES CITY MANAGER HOOVER said that due to an oversight by the Finance Department staff, the City failed to mail notices for the second half of this year's business license fees; however, all but approximately 150 of 4,000 business owners paid the full year's fee upon receipt of the notice for the first half of the year. MAYOR MONTGOMERY said that du mail the second -half notices, penalties be waived if these be established. e to the City's error in failing to she would recommend that late license fees are paid by a date to MOTION TO WAIVE LICENSE FEE PENALTY Mayor Montgomery offered motion, seconded by Commissioner Grumley, that an ordinance be drafted waiving late penalties for those businesses not receiving the notice for the second half of this year's license fee. COMMISSIONER RENFRO said she has received a complaint about the increase in costs between City and County for City recreational programs. MAYOR MONTGOMERY reported that she was in Memphis yesterday for the Executive Board Meeting for the I-69 Corridor Coalition. She handed out a Corridor 18 Feasibility Study and said it will be approximately one month before the study is finished. She said all the corridors in Western Kentucky qualify for this corridor and that Kentucky ranks as the 5th state in exports to Mexico and Canada. COMMISSIONER RENFRO gave an update on the Noble Park Renovation Project. 405 406 V SEPTEMBER 26, 1995 COMMISSIONER COLEMAN announced that PALS is sponsoring a Senior Citizens dance at 7 p.m., September 29, at the Civic Center. COMMISSIONER GRUMLEY announced that Commissioner Coleman was recently awarded the Lovey Rayburn Award for his numerous contributions to the Regional Mental Health Board. MOTION TO WAIVE CIVIC CENTER RENTAL FEES FOR THANKSGIVING DINNER FOR THE NEEDY Mayor Montgomery announced that she has received a request from Ted Fiorita asking the city to participate in a Thanksgiving dinner for 300 people. Mayor Montgomery offered motion, seconded by Commissioner Grumley, that Civic Center rental fees be waived for the Thanksgiving Dinner for the needy. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). MAYOR MONTGOMERY announced that the Purchase Health Department will offer flu and pneumonia shots on Monday, October 9, and Tuesday, October 10 from 8:00 a.m. to 3:45 p.m. at Lone Oak First Baptist Church, 3601 Lone Oak Road. It has been approved that City employees, with supervisor's prior approval, have time off work during these two days to get the shot(s) at the church, with the City reimbursing the $4.00 charge. A memo has been sent to City employees explaining this program. COMMISSIONER RENFRO said she has received complaints about juveniles congregating in the Concord School area and asked them to pick up and clean up after themselves. MAYOR MONTGOMERY announced that the Credit Bureau Systems plans to build a facility in the Information Age Park. This facility will house their corporate headquarters. Commissioner Grumley said this initial expansion will house more than 100 employees. MAYOR MONTGOMERY announced that leaf bags and accompanying information for this years leaf program will be distributed door-to-door during the first two weeks in October. Letters were going out today to the elderly and handicapped. Elderly and handicapped persons wishing to be placed in this program were instructed to call 444-8559 for assistance. CITY MANAGER HOOVER responded to Commissioner Renfro's inquiry that the restroom problem at Paxton Park has been remedied, pursuant to recent information from Kayo Mullen. EXECUTIVE SESSION Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board go into closed session for discussion of matters pertaining to the following topics: 1. Future sale or acquisition of a specific parcel(s) of real estate, as permitted by KRS 61.810(1)(b) 2. Collective bargaining with public employees, as permitted by KRS 61.810(1)(e) 3. Issues which might lead to the appointment, dismissal, or disciplining of an employee, as permitted by KRS 61.810(1)(f). Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). At the conclusion of the Executive Session the Board reconvened in open session and held a workshop. Upon motion the meeting adjourned.
