Therefore, the City must look to the Kentucky Model Procurement Code which has been adopted by the City (See Section 2-642). According to KRS 45A.375(4) when competitive bidding has been sought and no response from bidders have been received the local public agency may proceed to acquire the services through non-competitive negotiations in accordance with KRS 45A.380; and WHEREAS, KRS 45A.380(3) allows non-competitive negotiations when a written determination is made that competition is not feasible and the contract is for the services of a licensed professional such as a carpenter. Obviously, competition is not feasible since the City has advertised for bids, conducted a pre-bid walk through with six local contractors, and has received no bids. Also, the contractor who the city is considering awarding the contract is a locally licensed carpenter/contractor; and WHEREAS, in light of the foregoing, the city has elected to proceed with the negotiation of the contract on a non-competitive basis in accordance with KRS 45A.380(3).
