HomeMy WebLinkAbout2011-7-7829ORDINANCE NO. 2011-7-7829 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FOR 600 NORTH FOURTH STREET, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on June 20, 2011, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FROM R-4 (HIGH DENSITY RESIDENTIAL ZONE) TO B-3 (GENERAL BUSINESS ZONE) FOR PROPERTY LOCATED AT 600 NORTH FOURTH STREET," be approved as the final report of said Commission respecting the matters therein set forth. BEGINNING AT A POINT: Said point being the intersection of the centerlines of North 4th Street and Executive Boulevard at the junction of North Loop Road, thence following the centerline of North 4th Street in a Northwesterly direction a distance of Three Hundred Seventy-six feet and Ten inches to a point. Said point being the centerlines of the floodwall gate footprint and North 4th Street, thence following the centerline of the floodwall in a Northeasterly direction a distance of One Hundred Ninety-seven feet to a point. Said point being the centerline of the leg of the floodwall running Northwest to Southeast, thence following the centerline of the floodwall in a Southeasterly direction a distance of Three Hundred Sixty-one feet and extended in a straight line an additional Thirty-one feet to a point. Said point being the centerline of Executive Boulevard, thence following the centerline of Executive Boulevard in a Southwesterly direction a distance of Three Hundred Eight feet and Five inches to the point of beginning. The above description contains 94,960.80 square feet or 2.18 acres more or less. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the Comprehensive Plan of the City of Paducah. SECTION 3. That the zone classification of 600 North Fourth Street be, and it is hereby, changed from R-4 (High Density Residential Zone), to B-3, (General Business Zone): SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. ATTEST: Tammara S.
