HomeMy WebLinkAbout2011-5-7815136079 ORDINANCE 2011-5-7815 AN ORDINANCE ADOPTING A PROJECT -SPECIFIC PROCUREMENT CODE FOR THE JACKSON HOUSE ELEVATOR REBHABILITATION PROJECT WHEREAS, by ordinance enacted on April 26, 2011, the Board of Commissioners of the City of Paducah enacted Ordinance 2011-4-7808 accepting the Community Development Block Grant (the "Grant")from the Kentucky Department for Local Government for the Jackson House Elevator Rehabilitation Project (the "Project"): and WHEREAS, the Grant requires the City of Paducah to adopt a project- specific procurement code for the purchasing procedures to be followed by the City of Paducah as it pertains only to the Project; and WHEREAS, the Board of Commissioners desires to adopt a project- specific procurement code for the purchasing procedures to be followed by the City of Paducah as it pertains only to the Project; and WHEREAS, the Board of Commissioners does NOT desire to repeal, amend, or affect in anyway the provisions of Chapter 2, Article VIII, Division 3 Procurement of the Code of Ordinances of the City Of Paducah, Kentucky, the City's existing Procurement Code; and NOW, THEREFORE, be it ordained by the City of Paducah, Kentucky: SECTION 1. The City hereby adopts the provisions of the Jackson House Elevator Rehabilitation Procurement Code, a copy of which is attached hereto and made a part hereof as Exhibit A, which Procurement Code shall apply to and only be applicable to the Jackson House Elevator Rehabilitation Project. SECTION 2. Nothing contained in this Ordinance, approving the project -specific procurement code shall affect, repeal, or amend the provisions of Chapter 2, Article VIII, Division 3 Procurement of the Code of Ordinances of the City of Paducah, Kentucky, the City's existing Procurement Code. SECTION 3. Severability. If any section, paragraph or provision of this Ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such section, paragraph or provision shall not affect any of the remaining provisions of this Ordinance. SECTION 4. Compliance with Open Meetings Laws. The City Commission hereby finds and determines that all formal actions relative to the adoption of this Ordinance were taken in an open meeting of this City Commission, and that all deliberations of this City Commission,andof its committees, if any, which resulted in formal action, were in meetings open to the public, in full compliance with applicable legal requirements. SECTION 5. Conflicts. All ordinances, resolutions, orders or parts thereof in conflict with the provisions of this Ordinance are, to the extent of such conflict, hereby repealed and the provisions of this Ordinance shall prevail and be given effect. 1 SECTION 6.
