HomeMy WebLinkAbout02/01/94FEBRUARY 1, 1994 ROLL CALL At Regular Meeting of the Board of Commissioners held in the Commission Chambers at City Hall at 7:00 p.m., Tuesday, February 1, 1994, Mayor Montgomery presided, and upon call of the roll by the City Clerk, the following answered to their names: Commissioners Coleman, Grumley, Hornsby, Renfro, and Mayor Montgomery (5). PUBLIC FORUM AREA VIOLENCE Robin.Fasano, a violence in this possibility of a plans they have local resident, addressed the Commission about area. She suggested more police patrol, the v curfew, etc. She asked the Commission what to address this situation. Mayor Montgomery expressed her concerns about this situation. She told Ms. Fasano that changes would have to be made in the State law before a curfew could be imposed. AFSCME 1586 CONCERNS Steve Newton, an AFSCME Executive Board member, asked Commissioner Hornsby when he will need with Local 1586 to discuss a contract. Commissioner Hornsby told Mr. Newton that he would read a report later during the meeting tonight and then answer this question. Jim Rhodes, AFSCME President, commented on items brought out during the January 25 Commission Meeting; i.e., allegations of "Union busting", the pending AFSCME lawsuit, and reduction of AFSCME employees, and asked the Commission to join AFSCME at the bargaining table. MINUTES Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the reading of the minutes for January 25, 1994, be waived that the minutes of said meetings prepared by the City Clerk be approved as written. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro, and Mayor Montgomery (5). APPOINTMENTS PADUCAH CABLE COMMUNICATIONS AUTHORITY Mayor Montgomery made the following appointment: "WHEREAS, subject to the approval of the Board of Commissioners, I hereby appoint Jill Finch as a member of the Paducah Cable Communica- tions Authority for a term of four years, which term will expire October 15, 1997". � R411") Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners approve the action of Mayor Montgomery in appointing Jill Finch as a member of the Paducah Cable Communications Authority. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). MOTIONS R & F DOCUMENTS Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the following documents be received and filed: 1. CEMETERY Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that the Board of Commissioners approve the sale of the attached cemetery lot(s) and that the City Clerk is hereby authorized to execute a Deed of Conveyance for said cemetery lot(s), as follows: 1. Mary Elizabeth Jackson, Rushing Addition to Oak Grove Cemetery, Sec. 6, Lot 138 SW, in the amount of $225.00 (Receipt No. 5881) 2. Charles B. McGee, Rushing Addition to Oak Grove Cemetery, Sec. 9, Lot 118 SE, in the amount of $225.00 (Receipt No. 5887) Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). MUNICIPAL ORDERS PERSONNEL CHANGES 1. Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that upon the recommendation of the City Manager, the Board of Commissioners of the City of Paducah orders that the personnel changes on the attached list be approved. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). (SEE MUNICIPAL ORDER BOOK) ORDINANCES - INTRODUCTION AMEND 1993-94 BUDGET Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING ORDINANCE NO. 93-6-4956 ENTITLED, 'AN ORDINANCE ADOPTING THE CITY OF PADUCAH, KENTUCKY, ANNUAL BUDGET FOR THE FISCAL YEAR JULY 1, 1993, THROUGH JUNE 30, 1994, BY ESTIMATING REVENUES AND RESOURCES AND APPROPRIAT- ING FUNDS FOR THE OPERATION OF CITY GOVERNMENT'. This ordi- nance is summarized as follows: Amending the 1993-94 budget to authorize expenditure of 1993 encumbered funds and to increase the Cable Authority budget by $3,500.00". ORDINANCES - ADOPTION AMEND NONCIVIL SERVICE SEC. 2-47(H) Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SECTION 2-47(H), NONCIVIL SERVICE, DEPARTMENT OF PARKS AND LEISURE SERVICES, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Abolishing the position of Forester and creating the position of Grounds Resource Technician in the Parks and Leisure Services Department. FEBRUARY 11 1994 Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). ORD. NO. 94-2-5071, ORD.BK. 25, PAGE 33�- AMEND CIVIL SERVICE SEC. 10-55 Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SECTION 10-55, CIVIL SERVICE, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Creating the position of Laboratory Technician in the Wastewater Treatment Division. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). ORD. NO. 94-2-5072, ORD.BK. 25, PAGE 38g . DISCUSSIONS CITY MANAGER: 1. City Grant Applications Discussed procedure for handling budgetary grant (donation) applications received by the City; i.e., four possible methods: a. Letters b. Advertising c. Set aside funds d. Let people (organizations) come to City Hall and request grants Mr. Pennington stated that in the past the City has received applications in response to its letter stating criteria for obtaining a grant, and that this procedure has worked well. The Commission will study this procedure. Mayor Montgomery suggested that the City Manager look at available funds other than those already committed in the current budget. The City Manager will report on this next week. Commissioner Coleman. Due to his recent illness, Commissioner Coleman delayed his report on the following NAACP concerns: a. Demotion of Jonathan Hines b. WANT Report Commissioner Renfro read a written report on the following subject: a. The hiring of a biased Department Head (David Harvell) Her report contained the following results of a survey she conducted of 19 City Public Works employees who were asked if they felt the City hired a biased department head: No: 15 Yes: 2 (by hearsay only) Yes: 2 Mayor Montgomery has not completed her report but plans to give it next week. Commissioner Hornsby reported on stalled negotiations with AFSCME Local 1586. His investigation revealed that the City and Local 1586 can bargain only after AFSCME's pending lawsuit is resolved. He stated that he is personally ready to negotiate if lawsuit can be resolved. He again suggested that Bill Kressenberg handle future negotiations for the City. IN 29 FEBRUARY 1, 1994 Commissioner Coleman commented that all these matters need a speedy resolution and would like to see movement begin for an out of court settlement of the AFSCME lawsuit. Jim Rhodes, AFSCME President, related events that have occurred ✓ since the expiration of the AFSCME contract and refuted Commissioner Hornsby's statement concerning AFSCME electing to litigate instead of negotiate. Jimmy D. Mills, an employee of the Street Department, told the Commission that he does not feel that Local 1586 members are represented equally by the Union and asked that an election be held to determine if city employees want a union before any further negotiations are held. Commissioner Coleman told Mr. Mills that this procedure should be conducted by AFSCME Local 1586. Jim Rhodes spoke again and took exception to Mr. Mills' f statement and said he considers is a personal attack on himself. EXECUTIVE SESSION Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board go into closed session for discussion of matters pertaining to the following topics: Proposed or pending litigation, as permitted by KRS 61.810(1)(c); Collective bargaining with public employees, as permitted by KRS 61.810(1)(e); Issues which might lead to the appointment, dismissal, or disciplining of an employee; as permitted by KRS 61.810(1)(f). Adopted on call of the roll, yeas, Commissioners Coleman, -' Grumley, Hornsby, Renfro and Mayor Montgomery (5). At the conclusion of the Executive Session the Board reconvened in open session, whereupon the Mayor announced there was no further business. Upon motion the meeting adjourned.
