HomeMy WebLinkAbout01/25/9412 JANUARY 25, 1994 ROLL CALL At Regular Meeting of the Board of Commissioners held in the Commission Chambers at City Hall at 7:00 p.m., Tuesday, January 25, 1994, Mayor Montgomery presided, and upon call of the roll by the City Clerk, the following answered to their names: Commissioners Grumley, Hornsby, Renfro, and Mayor Montgomery (4). Commissioner Coleman was absent (1). LETTER OF APPRECIATION Mayor Montgomery read a letter to the Editor of the Paducah,5 un from the Commission about the snow and ice storm in Paducah last week. This was a letter of appreciation thanking community citizens for their cooperation during last week's inclement weather. City employees and their supervisors were also commended for their dedication and hard work during this time. Appreciation was also expressed to the National Guard, DES, private contractors and their personnel for providing equipment for snow removal, etc. MINUTES Mayor Montgomery offered motion, seconded by Commissioner Grumley, that the reading of the minutes for January 11, 14 and 21, 1994, be waived that the minutes of said meetings prepared by the City Clerk be approved as written. Adopted on call of the roll, yeas, Commissioners Grumley, Hornsby, Renfro, and Mayor Montgomery (4). MOTIONS R & F DOCUMENTS C Commissioner Grumley offered motion, seconded by Mayor Montgomery, that the following documents be received and filed: 1. MUNICIPAL ORDERS PERSONNEL CHANGES Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that upon the recommendation of the City Manager, the Board of Commissioners of the City of Paducah orders that the personnel changes on the attached list be approved. Adopted on call of the roll, yeas, Commissioners Grumley, Hornsby, Renfro and Mayor Montgomery (4). (SEE MUNICIPAL ORDER BOOK) GRANT APPLICATION FOR MARKET HOUSE THEATRE Commissioner Renfro offered motion, seconded by Commissioner 13 JANUARY 25, 1994 Hornsby, that a Municipal Order entitled, "A MUNICIPAL ORDER APPROVING THE APPLICATION FOR STATE ASSISTANCE UNDER THE 1994 KENTUCKY COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM THROUGH THE DEPARTMENT OF LOCAL GOVERNMENT, COMMONWEALTH OF KENTUCKY, AND AUTHORIZING THE MAYOR TO EXECUTE ALL DOCUMENTS PERTAINING TO SAID GRANT", be adopted. Adopted on call of the roll, yeas, Commissioners Grumley, Hornsby, Renfro and Mayor Montgomery (4). MUNICIPAL ORDER NO. 676, BOOK , PAGE ORDINANCES - EMERGENCY AMEND STREET RESURFACING MATERIAL QUANTITIES Mayor Montgomery offered motion, seconded by Commissioner Grumley, that the Board of Commissioners introduce and adopt an ordinance entitled, "AN ORDINANCE AMENDING ORDINANCE NO. 93-8-4998 ACCEPTING THE BID OF JIM SMITH CONTRACTING CO., INC. FOR RESURFACING VARIOUS STREETS IN THE CITY OF PADUCAH, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME". This ordinance is summarized as follows: Increasing the purchase quantities of bituminous surface, milling texture and asphalt overlay for street resurfacing, and declaring an emergency to exist. NO. 94-1-5068, BOOK 25, P. 89A ORDINANCES - INTRODUCTION AMEND NONCIVIL SERVICE SEC. 2-47(H) Commissioner Grumley offered motion, seconded by Mayor Montgomery, that the Board of Commissioners introduce an J ordinance entitled, "AN ORDINANCE AMENDING SECTION 2-47(H), NONCIVIL SERVICE, DEPARTMENT OF PARKS AND LEISURE SERVICES, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Abolishing the position of Forester and creating the position of Grounds Resource Technician in the Parks and Leisure Services Department. AMEND CIVIL SERVICE SEC. 10-55 Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING SECTION 10-55, CIVIL SERVICE, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Creating the position of Laboratory Technician in the Wastewater Treatment Division. ORDINANCES - ADOPTION AGREEMENT WITH FLORENCE & HUTCHESON FOR PROFESSIONAL ENGINEERING SERVICES ON GIS SYSTEM Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AN AGREEMENT IN AN AMOUNT NOT TO EXCEED $40,000 WITH FLORENCE AND HUTCHESON INC. FOR PROFESSIONAL ENGINEERING SERVICES ON A GEOGRAPHIC INFORMATION SYSTEM (GIS) FOR THE CITY OF PADUCAH". The above title summarizes the contents of this ordinance. ORDINANCE NO. 94-1-5069, BOOK 25, PAGE 67q CARDBOARD RECYCLING CONTRACT W/EASTER SEAL SOCIETY Mayor Montgomery offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE RATIFYING AND APPROVING THE EXECUTION OF A CONTRACT BETWEEN THE CITY OF PADUCAH, KENTUCKY, AND WEST KENTUCKY EASTER SEAL SOCIETY FOR THE RECYCLING OF CARDBOARD WASTE". The foregoing title summarizes the contents of this ordinance. ORDINANCE NO. 94-1-5070, BOOK 25, PAGE 375' DISCUSSIONS CITY MANAGER: JANUARY 25, 1994 1. Mandatory Sewer Connection Litigation Introduced Roger Colburn, Director of the Department of Environmental and Engineering Services, who discussed Mandatory Sewer Connections and an ordinances drafter by Lisa Emmons of Denton & Keuler Law Firm. This ordinances addresses enforcement remedies and penalties for failure to connect to available sewers. Mr. Colburn recommended taking criminal sanctions for violations out of the ordinance and placing violations under civil remedies. After discussion the Commission told Mr. Colburn they will study and consider this f ordinance for future action. MAYOR MONTGOMERY 1. Kentucky Municipal Clerks Association Donation The Commission decided to match donations by Calvert City, Benton and Madisonville of $1,000 each for the KMCA 1994 State Convention to be held at Kentucky Dam Village in April. 2. Asked for direction for City memberships in three organizations for the 1994-95 budget. 3. The Commission recommended that the Brannon Building remodeling be started as soon as economically possible so the Police Department can be relocated. The Commission said they will tour the building since.they have not seen inside it as of this date. The City Manager told the Commission that a minimum of $150,000 to $200,000 would be have to be expended before the Police Department could occupy the building. The Commissioner instructed the City Manager to report on this project at the February 8th Commission Meeting. Mayor Montgomery suggested that the City sell other City -owned buildings that are not being used except for "poor storage". The Commission concurred. COMMISSIONER HORNSBY Commissioner Hornsby asked the City manager about progress on establishing and instituting centralized purchasing. After discussion the City Manager told the Commission he will submit a draft of an ordinance he has had prepared for this project. He said he has been investigating this procedure in other cities and feels total centralization should be modified because it is not cost justifiable. Commissioners Hornsby and Grumley plan to present a program for purchasing in approximately two weeks. EXECUTIVE SESSION Commissioner Grumley offered motion, seconded by Mayor Montgomery, that the Board go into closed session for discussion of matters pertaining to the following topics: Issues which might lead to the appointment, dismissal, or disciplining of an employee; as permitted by KRS 61.810(1)(f). Adopted on call of the roll, yeas, Commissioners Grumley, Hornsby, Renfro and Mayor Montgomery (4). At the conclusion of the Executive Session the Board reconvened in open session, whereupon the Mayor called the meeting back to order. HUMAN RIGHTS DIRECTOR Commissioner Grumley offered motion, seconded by Commissioner Renfro, that the position of Human Rights Director be offered to Stanley L. Beauchamp, subject to his passing a pre-employment physical and drug screening. Adopted on call of the roll, yeas, Commissioners Grumley, Hornsby, Renfro and Mayor Montgomery (4). V 14 15 JANUARY 25, 1994 EXECUTIVE SESSION Commissioner Grumley offered motion, seconded by Commissioner Hornsby, that the Board go into closed session for discussion of matters pertaining to the following topics: Issues which might lead to the appointment, dismissal, or disciplining of an employee; as permitted by KRS 61.810(1)(f). Adopted on call of the roll, yeas, Commissioners Grumley, Hornsby, Renfro and Mayor Montgomery (4). At the conclusion of the Executive Session the Board reconvened in open session, whereupon the Mayor announced there was no further business. Upon motion the meeting adjourned.
