HomeMy WebLinkAbout01/04/94JANUARY 41 1994 At a Regular Meeting of the Board of Commissioners held in the Commission Chambers, City Hall, Paducah, Kentucky, at 7:00 p.m., January 4, 1994, Mayor Montgomery presided, and upon call of the roll by the City Clerk, the following answered to their names: Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). PRESENTATION OF PLAQUES Mayor Montgomery presented plagues to outgoing City Commissioners Feezor and Taylor and introduced the new Commissioners and made welcoming remarks. Newly sworn Commissioners Coleman and Renfro made statements concerning their objectives while serving on the Board. PUBLIC FORUM IRS Agent Ray McClennan requested budget figures for a balanced budget. Jimmy D. Mills, a city employee, addressed the Commission ✓ concerning his opposition to mandatory uniforms for public works employees. MINUTES Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the reading of the Minutes for December 21, 1993, be waived and that the Minutes of said meeting prepared by the City Clerk be approved as written. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). APPOINTMENTS PLANNING & ZONING COMMISSION Mayor Montgomery made the following appointment: "WHEREAS, -, subject to the approval of the Board of Commissioners, I hereby appoint Mary White as a member of the Paducah Planning and Zoning Commission for a term of four years, which term will expire August 31, 1997." ✓ Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners approve the action of Mayor Montgomery in appointing Mary White as a member of the Planning and Zoning Commission. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). MOTIONS NOTICE OF CANCELLATION OF MEETING Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Notice of Cancellation for the December 28, 1993, regular meeting be received and filed. R & F DOCUMENTS Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the following documents be received and filed: 1. Declaration of Surplus/Excess Property - this property consists of seven (7) fire trucks and related equipment. 2. Paducah Water Works General Ledger Balance Sheet for Period Ending 11/30/93 3. Paducah Water Works Monthly Report for December, 1993. National Linen Service CEMETERY LOTS Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners approve the sale of the attached cemetery lot(s) and that the City Clerk is hereby authorized to execute a Deed of Conveyance for said cemetery lot(s): 1. Violet Musgrow, Rushing Addition to Oak Grove Cemetery, Sec. 6, Lot 180 SW, in the amount of $225.00 (Receipt No. 5875) MUNICIPAL ORDERS PERSONNEL CHANGES Commissioner Coleman offered motion, seconded by Commissioner Grumley, that upon the recommendation of the City Manager, the Board of Commissioners of the City of Paducah orders that the personnel changes on the attached list at approved. ORDINANCE INTRODUCTIONS E911 DISPATCHERS Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING SECTION 2-47.5, 'NONCIVIL SERVICE GENERALLY', OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH,- KENTUCKY'. The foregoing ordinance is summarized as follows: Increase the number of dispatchers from 2 to 5. ,I'NFORMATION AGE PARK SEWER EXTENSION Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that the Board of Commissioners introduce an ordinance entitled, 'AN ORDINANCE ESTABLISHING THE AMOUNT TO BE CHARGED FOR�CONNECTING TO CITY SANITARY SEWERS CONSTRUCTED BY THE CITY KNOWN AS THE INFORMATION AGE PARK SEWER EXTENSION PROJECT AND PROVIDING FOR THE ISSUANCE OF CONNECTION PERMITS, PROVIDING FOR THE PAYMENT OF CONNECTION CHARGES, AND PROVIDING PENALTIES FOR VIOLATION OF THE PROVISIONS HEREOF'. This ordinance is summarized as follows: Establishing fee for sewer connection in the Information Age Park sewer project at $1,815.00 per acre for each tract developed". BLOOM AVENUE SEWER EXTENSION Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners introduce an ordinance Ll entitled,. -AN ORDINANCE ESTABLISHING THE AMOUNT TO BE CHARGED FOR CONNECTING TO CITY SANITARY SEWERS CONSTRUCTED BY THE CITY KNOWN AS THE 1993 BLOOM AVENUE SEWER EXTENSION PROJECT AND PROVIDING FOR THE ISSUANCE OF CONNECTION PERMITS, PROVIDING FOR THE PAYMENT OF CONNECTION CHARGES AND PROVIDING PENALTIES FOR VIOLATION OF THE PROVISIONS HEREOF'. This ordinance is summarized as follows: Establishing fee for sewer connections in the 1993 Bloom Avenue Sewer project at $650.00 for each single family residence." UNIFORM RENTAL/CLEANING Commissioner Coleman offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners introduce an ordinance entitled, 'AN ORDINANCE ACCEPTING THE BID OF ARATEX SERVICES INC. IN AN AMOUNT NOT TO EXCEED $36,910.00 FOR THE 3 JANUARY 41 1994 RENTAL/CLEANING OF UNIFORMS AND MISCELLANEOUS ITEMS FOR USE BY EMPLOYEES IN THE DEPARTMENT OF PUBLIC WORKS, DEPARTMENT OF ENVIRONMENTAL AND ENGINEERING SERVICES AND THE DEPARTMENT OF PARKS AND LEISURE SERVICES AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME'. The foregoing title summarizes the contents of this ordinance". ORDINANCE ADOPTIONS E-911 MAINTENANCE AGREEMENT Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE A MAINTENANCE AGREEMENT WITH E911 SERVICE, ACTING BY AND THROUGH THE PADUCAH-McCRACKEN COUNTY EMERGENCY COMMUNICATION SERVICE BOARD". The above title summarizes the contents of this ordinance. Adopted on call of the roll, yeas, Commissioners Coleman, Grumle ornsby, Renfro and Mayor Montgomery (5). 01Zt 3 T 1-5656' Q$0.13k 25 j p9 3&6 PINES SUBDIVISION, SECTION III Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF KEILER AND MAY PROPERTIES, LOCATED IN PINES SUBDIVISION -SECTION III, LOCATED WEST OF DEER PATH LANE, WEST OF WHITNEY DRIVE, AND EAST OF I-24, ACCEPTING THE DEDICATION OF PUBLIC RIGHTS-OF-WAY AND EASEMENTS AND ACCEPTING A LETTER OF CREDIT". This ordinance is summarized as follows: Approving the final report of the Paducah Planning Commission respecting the proposed subdivision of property of Keiler and May, located in Pines Subdivision -Section III, accepting the dedication of public rights-of-way and easements, and accepting a letter of credit in the amount of $18,550. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). 0R p rt 9' q_/- 5 D 5 j og t9/3k 25 j 3� 7 AMEND NONCIVIL SERVICE SEC. 2$47(A) Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SECTION 2-47(A), NONCIVIL SERVICE, DEPARTMENT OF COMMUNITY PLANNING AND DEVELOPMENT, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Increasing the pay grade and salary of the City Planner. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5) . 0RD*t-gq_1 _sa(,,b ;oR0 6k, 26 ; P5 3&y PROHIBIT OCCUPANCY OF UNINHABITABLE BUILDINGS Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE PROHIBITING OCCUPANCY OF UNINHABITABLE BUILDINGS AND AUTHORIZING TERMINATION OF UTILITY SERVICE TO SAME". This ordinance is summarized as follows: Establishing guidelines to prohibit occupancy of uninhabitable buildings, setting penalties for unlawful occupancy, and authorizing termination of utility service to uninhabitable buildings. ORp -11-4 _f- 50(, 1 0 a 6)< 2 S 37 DISCUSSIONS Commissioner Grumley asked about the possibility of having the railroad crossing on Allen Lane repaired. City Manager Jim Pennington told Commissioner Grumley that Don Harper is working on this project with the railroad. Commissioner Coleman also told the Commissioner that the railroad crossing on North 9th Street between Harrison & Clay Streets is in bad repair. He suggested the railroad be made aware of this problem. rd JANUARY 4, 1994 Mayor Montgomery discussed the method of addressing minority concerns in the City. She said requests made by the NAACP have been discussed during recent meetings with them. She asked the City Manager to prepare data necessary to address each issue and concern so the Commission can take that data and try to make a decision on each issue. She also asked the Board for feedback. Commissioner Hornsby agreed with the Mayor. Commissioner Coleman suggested that individuals other than Board members be included in this decision process. Commissioner Grumley requested information on each issue in order to make a determination on each issue. Mayor Montgomery wants legal direction before further pursuit of this matter. Mayor Montgomery read the Handicapped Elderly Leaf Program. There are presently 201 residents requesting this service which will begin on January 10, 1994 and end on February 14, 1994. The City Manger said this will be the final pickup for this season. EXECUTIVE SESSION Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board to into closed session for discussion of matters pertaining to the following topic: 1. Collective bargaining with public employees; as permitted by KRS 61.810(1)(f). Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). At the conclusion of the Executive Session the Board reconvened in Open Session, whereupon the Mayor announced there was no further business. Upon motion the meeting adjourned.
