HomeMy WebLinkAbout2011-4-7805ORDINANCE NO. 2011-4-7805 AN ORDINANCE OF THE CITY OF PADUCAH, KENTUCKY, APPROVING AN ENGINEERING CONSULTING SERVICE CONTRACT FOR THE RIVERFRONT DEVELOPMENT PROJECT; AND AUTHORIZING THE EXECUTION OF SAID CONTRACT WHEREAS, the City desires to obtain the necessary approvals and permits for the Riverfront Redevelopment Project in order to proceed with the Project; and WHEREAS, to do so, it will be necessary for the City to fulfill additional permitting and environmental challenges, obligations and requirements as mandated by Federal and State Governmental entitled; and WHEREAS, additional Professional Consulting Engineering Services are required to assist the City with the completion of the obligatory permitting and environmental regulatory requirements as required for the Riverfront Redevelopment Project; and WHEREAS, Florence & Hutcheson has in its employ, persons experienced in the above mentioned areas of expertise; and contract. WHEREAS, the City desires to approve and authorize the Mayor to execute the BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. Recitals and Authorization. The City hereby approves the Engineering Consulting Service Contract between the City of Paducah and Florence & Hutcheson, Inc., in substantially the form attached hereto and made part hereof for the Riverfront Redevelopment Project. It is further determined that it is necessary and desirable and in the best interests of the City to enter into the Contract for the purposes therein specified, and the execution and delivery of the Contract is hereby authorized and approved. Further, the Mayor of the City is hereby authorized to execute the Contract. SECTION 2. Compensation. The City shall compensate Florence & Hutcheson, Inc., on a monthly basis for work completed on a "Time and Material" basis in accordance with the rate schedule attached to the Contract as Appendix A. Said compensation paid by the City shall be funded through project account DT0015. SECTION 3. Severability. If any section, paragraph or provision of this Ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such section, paragraph or provision shall not affect any of the remaining provisions of this Ordinance. SECTION 4. Compliance With Open Meetings Laws. The City Commission hereby finds and determines that all formal actions relative to the adoption of this Ordinance were taken in an open meeting of this City Commission, and that all deliberations of this City Commission and of its committees, if any, which resulted in formal action, were in meetings open to the public, in full compliance with applicable legal requirements. SECTION 5. Conflicts. All ordinances, resolutions, orders or parts thereof in conflict with the provisions of this Ordinance are, to the extent of such conflict, hereby repealed and the provisions of this Ordinance shall prevail and be given effect. SECTION 6. Effective Date. This Ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. ATTEST: J Tammara S.
