HomeMy WebLinkAbout11/22/94214 NOVEMBER 22, 1994 ROLL CALL At a Regular Meeting of the Board of Commissioners held in the Commission Chambers at City Hall at 7:00 p.m., Tuesday, November 22, 1994, Mayor Montgomery presided, and upon call of the roll by the City Clerk, the following answered to their names: Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). _.� MINUTES Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the reading of the Minutes for November 15 AND 17, 1994, be waived and that the Minutes of said meeting prepared by the City Clerk be approved as written. R & F DOCUMENTS Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the following documents be received and filed: 1. Certificates of Insurance: a. B & J Construction Inc. 2. MUNICIPAL ORDERS PERSONNEL CHANGES Commissioner Grumley offered motion, seconded by Commissioner Coleman, that upon the recommendation of the City Manager, the Board of Commissioners of the City of Paducah orders that the personnel changes on the attached list be approved. ORDINANCES - EMERGENCY ABOLISH OFFICE OF ALCOHOLIC BEVERAGE ADMINISTRATOR AND AMEND CHAPTER 3 Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that the Board of Commissioners introduce and adopt an ordinance entitled, "AN ORDINANCE ABOLISHING THE OFFICE OF THE CITY OF PADUCAH ALCOHOLIC BEVERAGE ADMINISTRATOR AND AMENDING CHAPTER 3, ALCOHOLIC BEVERAGES, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH". This ordinance is summarized as follows: Abolishing the office of the City of Paducah Alcoholic Beverage Administrator, amending Chapter 3, Alcoholic Beverages, of the Code of Ordinances, and assigning the duties of the office of the City Alcoholic Beverage Administrator to the City Manager. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). ORDINANCE NO. 94-11-5221, BOOK 26, P. (�_. 215 NOVEMBER 22, 1994 ABOLISH ALCOHOLIC BEVERAGE ADMINISTRATOR SALARY ORDINANCE - SEC. 2-52 Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners introduce and adopt an ordinance entitled, "AN ORDINANCE ABOLISHING SECTION 2-52, V/ ALCOHOLIC BEVERAGE ADMINISTRATOR, OF ARTICLE III, CHAPTER 2, ADMINISTRATION, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Abolish- ing Section 2-52, which establishes the salary of the Alcoholic Beverage Administrator. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). ORDINANCE NO. 94-11-5222, BOOK 26, P.�(' CONTRACT FOR CONSTRUCTION OF RIVERFRONT BLEACHERS Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners introduce and adopt an ordinance entitled, "AN ORDINANCE ACCEPTING THE BID OF ✓ CONSOLIDATED CONTRACTORS INC. IN THE AMOUNT OF $78,280 FOR CONSTRUCTION OF RIVERFRONT BLEACHERS AT THE FOOT OF BROADWAY, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME". ORDINANCE NO. 94-11-5223, BOOK 26, P. r17 - CHANGE ORDER NO. 1 - FIRST STREET RENOVATION PROJECT ($778.50 DECREASE IN CONTRACT) Commissioner Grumley offered motion, seconded by Commissioner / Coleman, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE CHANGE ORDER NO. 1 IN THE AMOUNT OF $778.50 WITH JIM SMITH CONTRACTING COMPANY INC. FOR THE FIRST STREET RENOVATION PROJECT". This ordinance is summarized as follows: Authorizing the Mayor to execute Change Order No. 1 with Jim Smith Contracting Company for a contract reduction of $778.50 for the First Street Renovation T Project. CHANGE 46TH STREET TO NORTHGATE LANE Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE CHANGING THE NAME OF A PORTION OF 46TH STREET TO NORTHGATE LANE". This ordinance is summarized as follows: Changing the name of 46th Street to Northgate Lane between Buckner Lane and Exall Lane. PADUCAH WATER WORKS UTILITY EASEMENT THROUGH STUART NELSON PARK Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE GRANTING PADUCAH WATER WORKS A PERPETUAL UTILITY EASEMENT ON CITY PROPERTY KNOWN AS STUART ✓ NELSON PARK". This ordinance is summarized as follows: Authorizing and directing the Mayor to execute a permanent and perpetual utility easement across a parcel of real estate owned by the City of Paducah, known as Stuart Nelson Park, to Paducah Water Works; and authorizing and directing the Corporation Counsel to prepare said easement. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5).. ORDINANCE NO. 94-11-5226, BOOK 26, P. 9Q) PADUCAH WATER WORKS EASEMENT ACROSS GRAMSE PARCEL Commissioner Grumley offered motion, seconded by Commissioner V Coleman, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE GRANTING PADUCAH WATER WORKS A PERPETUAL UTILITY EASEMENT ON CITY PROPERTY KNOWN AS THE GRAMSE PARCEL". This ordinance is summarized as follows: Authorizing and directing the Mayor to execute a permanent and perpetual utility easement across a parcel of real estate owned by the 216 NOVEMBER 22, 1994 City of Paducah, known as the Gramse Parcel, to Paducah Water Works; and authorizing and directing the Corporation Counsel to z/ prepare said easement. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). ORDINANCE NO. 94-11-5227, BOOK 26, P. . WITHDRAW ETHICS ORDINANCE Commissioner Renfro requested permission to withdraw the motion to introduce an ordinance establishing a Code of Ethical Conduct Applicable to the Officers and Employees of the City of Paducah, which was made on November 151 1994. Mayor Montgomery replied as follows: "Unless there is objection [pause] the motion is withdrawn". There being no objection, the motion was withdrawn. ORDINANCE INTRODUCTION: ETHICS ORDINANCE Commissioner Renfro offered the following motion, seconded by Commissioner Hornsby: "I hereby move the introduction of an ordinance entitled, "AN ORDINANCE ESTABLISHING A CODE OF ETHICAL CONDUCT APPLICABLE TO THE OFFICERS AND EMPLOYEES OF THE CITY", a summary of which is as follows: This ordinance is summarized as enacting a Code of Ethics for city officers, candidates for city office, and city employees and, as required by House Bill 238 of the 1994 General Assembly, containing provisions which set forth: (1) standards of conduct for elected and appointed officials and employees; (2) requirements for filing financial disclosure statements by elected city officers, candidates for elected city officers, and the city manager; (3) a policy on the employment of members of families of city officers and employees; (4) the creation of a Board of Ethics for receiving and investigation of complaints, conducting hearings, and enforcing the Code of Ethics; and (5) Class A Misdemeanor penalties are imposed for violations of the following sections: Section 17, 20(g), 21(f) . Civil penalties of up to $10,000.00 are imposed for violations of the following sections: Section 5, 7, 8, 9(a), 10, 11(a), 12, 13, 18(a), (b) (c), (d) and 26(a). DISCUSSIONS: Commissioner Coleman stated that 31 years ago on this date President John F. Kennedy was assassinated. City Manager Hoover said he has completed 79 days of employment with the City on this date. Mayor Montgomery announced the Festival of Lights, beginning at 4:30 p.m. Saturday, November 26, 1994. Mayor Montgomery also announced that City of Paducah Christmas Cards are available for sale in the Finance Office at a price of 25 for $25, or 75 cents each. Commissioner Grumley announced that he is receiving calls about leaf pickup and reminded the public that leaves are not to be placed in city ditches or adjacent curbs. EXECUTIVE SESSION Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board go into closed session for discussion of matters pertaining to the following topics: 1. Issues which might lead to the appointment, dismissal, or disciplining of an employee; as permitted by KRS 61.810 (1)(f). 217 NOVEMBER 22, 1994 Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). At the conclusion of the Executive Session the Board reconvened in Open Session, whereupon the Mayor announced there was no further business. Upon motion the meeting adjourned.
