AN ORDINANCE AUTHORIZING THE FINANCE DIRECTOR TO PAY
FOR THE PURCHASE OF BODY ARMOR FOR THE PADUCAH POLICE
DEPARTMENT
WHEREAS, the Police Department, in January 2010, requested written bids
for body armor for police officers because sealed bids were not required due to purchase
being less than $20,000; and
WHEREAS, Ray O'Herron, Inc., was the only company that submitted a bid
that met specifications; and
WHEREAS, Ray O'Herron executed a contract with the City, signed by the
Police Chief, for a two-year contract to lock in the price for the body armor at $600 each; and
WHEREAS, the Police Department was going to make purchases of body
armor for new hires, scheduled replacements and because it was discovered during budget
preparations that a minimum of 39 pieces would have to be purchased during the 2011 fiscal
year five year due to expiration of safety guarantee due to material issues from the
manufacturer, therefore, making the purchase of the body armor exceed the small purchase
plan allowance of $20,000; and
WHEREAS, the City has been awarded grants from the Kentucky Office of
Homeland Security allowing the purchase of the required units of body armor and during
consultation with the City Attorney advised the Police Department to honor the contract
executed in January and request the City allow the Finance Director to make payment to Ray
O'Herron, Inc., in an amount not to exceed $30,000 during the 2011 fiscal year.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Finance Director is hereby authorized to pay for the
purchase of body armor for the Paducah Police Department in an amount not to exceed
$30,000 from the Ray O'Herron Company Inc. This purchase will be paid for with Kentucky
Office of Homeland Security grants.
SECTION 2. This expenditure shall be charged to the Police Department
Services Other; project account P00055.
SECTION 3. This ordinance shall be read on two separate days and will
become effective upon summary publication pursuant to KRS Chapter 424.
