AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A FIVE-
YEAR RENEWAL AND AMENDMENT AGREEMENT WITH REPUBLIC SERVICES OF
KENTUCKY, LLC, (FORMERLY COMMERCIAL WASTE DISPOSAL, INC.) FOR
DISPOSAL OF CITY MUNICIPAL SOLID WASTE AND CERTAIN OTHER WASTE
WHEREAS, Ordinance No. 94-11-5220, adopted by the City of Paducah on
November 15, 1994, authorized the execution of a contract between the County and City of
Paducah and Waste Disposal, Inc., D.B.A. CWDI. The term of this agreement was for a period
of ten (10) years, commencing July 1, 1995, concluding June 30, 2005, with two (2) consecutive
five (5) year renewal terms to follow immediately thereafter if such renewals are mutually agreed
upon by the parties; and
WHEREAS, Ordinance No. 2005-4-6960, adopted by the City of Paducah on
April 26, 2005, authorized the City to exercise the first five (5) year renewal term, ending June
30, 2010; and
WHEREAS, the City of Paducah is now desirous to renew the second five (5)
year renewal term, ending June 30, 2015.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Mayor is hereby authorized to execute a Five -Year Renewal
and Amendment Agreement with Republic Services of Kentucky, LLC (formerly Commercial
Waste Disposal, Inc.), for disposal of city municipal solid waste, and certain other waste. This
amended agreement identifies the original terms and reaffirms and/or amends the conditions as
noted. Said contract is in substantial compliance with the bid specifications, advertisement for
bids and bids dated December 12, 1994.
SECTION 2. This expenditure shall be charged to various landfill accounts.
SECTION 3. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
