AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN
ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH AND SIGNATURE
HOMES OF PADUCAH, LLC, FOR AN ENCROACHMENT UPON A PORTION OF CITY OF
PADUCAH RIGHT-OF-WAY OF WESTWOOD BOULEVARD
WHEREAS, Signature Homes of Paducah, LLC, is the owner of property known as
Westwood Hills Subdivision, situated in Paducah, McCracken County, Kentucky; and
WHEREAS, the City of Paducah is the owner of a portion of Westwood Boulevard
located adjacent to Signature Homes of Paducah, LLC, property, situated in Paducah, McCracken County,
Kentucky; and
WHEREAS, Signature Homes of Paducah, LLC, is desirous of encroaching upon and
utilizing a portion of the right of way of Westwood Boulevard to construct a subdivision sign and a water
irrigation system; and
WHEREAS, the City is desirous of permitting the aforesaid encroachment by Signature
Homes of Paducah, LLC; and
WHEREAS, the City of Paducah and Signature Homes of Paducah, LLC, have now
entered into an agreement pertaining to the foregoing and do desire that same be set forth in writing and
be made part of the public records of the City of Paducah, Kentucky, and recorded in the office of the
County Court Clerk of McCracken County, Kentucky.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah hereby approves the Encroachment Agreement
with Signature Homes of Paducah, LLC, for a subdivision sign and water irrigation system to be located
upon a portion of City of Paducah right-of-way of Westwood Boulevard.
SECTION 2. That the Mayor is hereby authorized to execute the Encroachment
Agreement with Signature Homes of Paducah, LLC, as approved in Section I above.
SECTION 3. That the City authorizes the City Engineer -Public Works Director to give
written consent allowing for the transfer of the Encroachment Agreement from Signature Homes of
Paducah, LLC, to the Homeowners Association upon its creation.
SECTION 4. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 4T4.
