AN ORDINANCE APPROVING A SPECIAL CONSTRUCTION
AGREEMENT WITH BELLSOUTH TELECOMMUNICATIONS, INC., D/B/A AT&T
SOUTHEAST FOR THE RELOCATION OF AN EXISTING TELEPHONE CABINET
AND RELATED EQUIPMENT FOR THE OLIVET CHURCH ROAD
IMPROVEMENT PROJECT, AND AUTHORIZING THE MAYOR TO EXECUTE AN
AGREEMENT FOR SAME
WHEREAS, during the design phase of the Olivet Church Road
Improvement Project, it was discovered that a major AT&T telephone cabinet along with
related equipment located at 3566 Olivet Church Road would be in conflict with
construction of the new roadway; and
WHEREAS, discussions were held with AT&T regarding the relocation of
this equipment along with the associated costs and AT&T is requiring a Special
Construction Agreement and advance payment before they will initiate any work; and
WHEREAS, the City of Paducah adopted Ordinance No. 2007-2-7247 on
February 13, 2007, entering into an Agreement with the Commonwealth of Kentucky,
Transportation Cabinet, Department of Highways, for reimbursement up to $2,000,000
for right of way acquisition and utility relocation for the Olivet Church Road
Improvement Project.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah hereby approves a Special
Construction Agreement with BellSouth Telecommunications, Inc., d/b/a AT&T
Southeast for the relocation of an existing telephone cabinet along with related equipment
for the Olivet Church Road Improvement Project in the amount of $193,025.78 and
authorizes the Mayor to execute an agreement for same. Payment in full is required
before the Special Construction will begin.
SECTION 2. This expenditure shall be charged to the Olivet Church
Road Project Account No. ST0027.
SECTION 3. This ordinance shall be read on two separate days and will
become effective upon summary publication pursuant to KRS Chapter 424.
