HomeMy WebLinkAboutAcquisition of property from Hibbs, Walls, Ingram, et al58 9 A RESOLUTION RECITING THE NEED FOR ACQUTR,ING A CERTAIN PARCEL OF LAND BELONGING TO HENRY LEE HIBBS, AND WIFE, JANETTA HIBBS; ELLA WALLS AND BILL WALLS, HER SPOUSE; TOM INGRAM, SINGLE; THE UNKNOWN HETR,S, ASSIGNS, SPOUSES, ~DEVTSEES, LEGATEES, CONSORTS A ND GRANTEES OF PAUL JOHNSON; AND THE UNKNOWN'~HEIRS,' ASSIGNS, SPOUSES, DEVISEES, LEGATEES, CONSORTS, AND GRANTEES OF EVELYN JOHNSON; TO BE USED FOR THE COMPLETION OF THE INTERIM COMMUNITY DEVELOPMENT PLAN AND PROVIDING FOR AND AUTHORIZING THE CON- DEMNATION OF SAME WHEREAS, a parcel of real estate is owned of record by Ella Walls and Henry Lee Hibbs, and is necessary for the completion of the Interim Community Development Plan, Application No. B-75HN=21-0009, and WHEREAS ~ the 'Urban Renewal- and Communit Development Agency, by resolution dated May 4, 1976, requested institution on Condemnation proceedings in its behalf, and, WHEREAS, it does not appear that a purchase agreement can be reaced at this time with the owners of the subject` property as the ownership- is in dispute, and WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky, does therefore agree' with the request of the Urban Renewal and Community Develop- ment Agency of the City of Paducah, Kentucky, that it will be necessary to institute ,_ condemnaton'proceedings pursuant to the' Kentucky Revised Statutes to acquire title to this property . NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Assistant Corporation Counsel be, and he is hereby, ordered and directed to institute condemnation proceedings in the McCracken Circuit Court against Henry Lee Hibbs, and wife, Janetta Hibbs; Ella Walls and Bill Walls, _. ~, her spouse; Tom Ingram, single, the unknown heirs; assigns, spouses, devisees, legatees, consorts and g~antee~s of Paul Johnson; and the unknown heirs, assigns, spouses, devisees, legatees, consorts and grantees of Evelyn Johnson, County of McCracken, State of Kentucky; and any and all other parties in interest to acquire all of the right, title and interest in the subject property owned by aforementioned. SECTION 2. That the parcel to be taken is more particularly described as follows: 590 Being a part of Block' No. 27, Addi#ion. "C", to the' City of Paducah, Kentucky, and being on the South side of Adams Street between 8th and' 9th Streets, and beginning::"at a point 104 feet 6 inches from the southeast corner of the intersection of''9th' aril Adams Streets; ~ thence with the - South line of Adams Street and toward 8th Street 56 feet 4 inches, more or less, to th'e line of 'an alley about 13 feet wide, and running from Adams Street to Jackson Street; - thence at'right"'angles' and along the .l.i.rie of said alley an towards Jackson Street 71 feet; thence at right angles and parallel with Adams Street and towards 9th Street 56 feet 4 inches; thence at right angles and toward Adams Street 7if `feet," more or ~ less; to' the" beginning point on .Adarri's Street.
