HomeMy WebLinkAbout77-8-1451576 ORDINANCE NO. 77-8-1451 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE REZONING OF PROPERTY LOCATED ON THE SOUTHWEST CORNER OF SOUTH FIFTH AND ELIZABETH STREETS, AND AMENDING THE PADUCAH ZONING ORDINANCE - 1976 SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY; SECTION 1. That a resolution adopted by the Paducah Planning Com- mission on July 18, 1977, entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED REZONING OF PROPERTY OF ERVIN SHELBY, LOCATED ON THE SOUTHWEST CORNER OF SOUTH FIFTH AND ELIZABETH STREETS", be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification change and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following property be, and it is hereby, changed from R-3 Residential Zone to B-1 Convenience and Service Zone: Beginning at a point in the centerline of an alley lying parallel and midway between So. 5th Street and So. 6th Street, which alley runs a southeasterly direction from Elizabeth Street,; which point is 115.5' southeast of the southeasterly right-of- way line of Elizabeth Street; thence in a north- easterly direction and along a line abutting the property of A. F. Thommason to the centerline of So. 5th Street; thence in a northwesterly di- rection and with the centerline of So. 5th Street to the point where said centerline intersects with the centerline of Elizabeth Street; thence in a southwesterly direction and with the centerline of Elizabeth Street to the point where the center- line of aforesaid alley, if extended, would intersect with the centerline of Elizabeth Street; thence in a Southeasterly direction and with the centerline of said alley to the point of beginning. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. 577 SECTION 5. This ordinance shall be in full force and effect from and after the date of its adoption. Mayor
