Home My WebLink About77-2-1381407 ORDINANCE NO. 77-2-1381 AN ORDINANCE AMENDING SECTION 19-67 OF AN ORDINANCE PRO- HIBITING DISORDERLY CONDUCT WITHIN THE CITY OF PADUCAH , AND PRESCRIBING PENALTIES FOR VIOLATIONS WHEREAS, the enactment of the Penal Code by the General Assembly of the Commonwealth of Kentucky, which code is presently in effect in the Commonwealth of Kentucky, set certain criteria for punishment according to the classification of crimes, and Section 19-67 of the Code of Ordinances of the City of Paducah, Kentucky is cur- rently in conflict with limits of punishment as enacted by the Penal code, and WHEREAS, under KRS 534.040 and under Section 168 of the Constitution of Kentucky, any punishment imposed under Section 19-67 of an ordinance "Prohibiting Disorderly Conduct within the City of Paducah" would be unconstitutional, NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 19-67 as amended and reordained shall hereafter read as follows: Any person violating any section of this article or committing any act declared by this article to be unlawful or a misdemeanor shall be punished as follows: 1. Any act declared by this section to be a misdemeanor, shall be here- under termed a Class B Misdemeanor and shall have punishment set in accordance with KRS Chapter 500, et seq, known as the Kentucky Penal Code for Class B Misdemeanors, to wit: a fine not exceeding two hundred and fifty ($250.00) and/or imprisonment in the City jail not to exceed ninety (90) days; and 2. Any act declared by this section to be unlawful, and not designated as a misdemeanor, shall be hereunder termed a violation, and the punishment shall be imposed in accordance with KRS Chapter 500, et seq, known as the Kentucky Penal Code, for violations, to wit: a fine not exceeding two hundred and fifty dollars ($250.00) . SECTION 2. All ordinances -and parts of ordinances in conflict herewith are hereby repealed. SECTION 3.
