NO.,..7,0-r~~-1229 AN ORDINANCE DECLARING THE VACATION OF POSITIONS BY MEMBERS OF THE FIRE DEPARTMENT OF THE CITY OF PADUCAH WHO FAIL TO REPORT FOR DUTY ON FEBRUARY 19, 1976, AT THE HOUR OF 1: 00 P .M . , PREVAILING TIME WHEREAS , a withdrawal o f services by certain members of the City of Paducah Fire Department that was announced and commenced on February 16, 1976, has seriously jeopardized the safety of persons and property within the City of Paducah , Kentucky , and ;_ ,. WHEREAS , there has been no indication that any of said members of ,: .- - ,.. the Fire Department who have withdrawn their services have any intention of resuming their duties as firemen for the City of Paducah, and WHEREAS , it is essential that adequate firefighting personnel be maintained at all times for the safety of the community, and WHEREAS , a determination of the existence of vacancies is necessary so that replacement personnel can be recruited and employed . NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH , KENTUCKY: SECTION ~ 1.. That the Chief of the Fire Department of the City of Paducah is hereby authorized and directed to issue a general Order directing all members of the Fire Department of the City of Paducah to report to Fire Station #1, on February 19, 1976, at the hour of 1: 00 P.M. , prevailing time, for purpose of carrying out any and all duties and orders that the Fire Chief may assign to them in order to provide immediate and constant fire protection for the City of Paducah. SECTION 2. That any member of the Fire Department who fails to report for duty as provided in Section 1 above , or who , after reporting for said duty , fails to faithfully carry out the duties assigned to him , or who leaves his duty post without prior approval of the Fire Chief, shall be deemed to have vacated his position of employment with the City of Paducah Fire Department, and all rights and privileges pertaining thereto . Any member of the Paducah Fire Department who desires to be lawfully excused from reporting to duty as set forth in Section 1 above, must receive prior written approval from the City Manager . SECTION 3. That the Fire Chief shall forthwith report to the City Manager the names and positions of those persons, if any, who either fail to report to duty as ordered or fail to carry out his orders or who leaves his duty post without prior 53 approval from the Fire Chief; the City Manager sliall immediately prepare the necessary personnel actions to vacate the positions of those persons as reported to him by the Fire Chief . SECTION 4. That the City Manager shall immediately begin accepting applica- tons from persons desiring to become members of the City of Paducah Fire Department and filling the aforesaid vacated positions.. SECTION "5 . That the City Manager shalldirect the City Treasurer to immediately prepare all pay and allowances due to those members of the Fire Department who have "been deemed to have vacated their respective positions-'of employment with the City of Paducah -SECTION 6. The City Manager shall direct the City Clerk, immediately upon adoption of this ordinance , to' disseminate copies of this ordinance to all members of the local press for purposes of immediate press release; a copy hereof shall be posted upon the bulletin board in the foyer of the City Hall of the City of Paducah; the City Manager shall further direct the Chief of Police to have a copy of this ordinance personally delivered to all firefighters or to the firefighters' last known addresses -SECTION 7. This ordinance shall be in full force and effect until rescinded or amended by further action of this Board, and all ordinances and parts of ordinances, in conflict herewith, are to the extent of such conflict temporarily rescinded'or held in abeyance during the duration of the effectiveness of this ordinance and no further . SECTION 8 . If any paragraph or section of this ordinance , or any portion thereof, be found by any Court to be invalid, such invalidity shall not affect the validity of any other paragraph, section, or part of this ordinance, itbeng~the intention of the Board of Commissioners to severally pass each and every paragraph, part or section hereof . SECTION 9. An emergency is declared to exist, due to peril to,persons and property in the City, and this ordinance shall be in -full force and effect immediately upon its adoption . ~ .. ~.. ~~ _u..~zi -c..
