HomeMy WebLinkAbout04/12/00202 APRIL 12, 2000 At a Called Meeting of the Board of Commissioners held in the Commission Chambers at City Hall at 5:30 p.m., Wednesday, April 12, 2000, Mayor Jones presided, and upon call of the roll by the City Clerk, the following answered to their names: Commissioners Coleman, Paxton, Smith, Wrye and Mayor Jones (5). NOTICES OF CALLED MEETING Commissioner Coleman offered motion, seconded by Commissioner Wrye, that the executed copies of the Notice of Called Meeting to be held at 5:30 p.m., Wednesday, April 12, 2000, be received and filed. Adopted on call of the roll, yeas, Commissioners Coleman, Paxton, Smith, Wrye and Mayor Jones (5). This meeting was held for the purpose of hearing charges against Firefighter Jason York, brought by Fire Chief Redell Benton. York appeared in person with his attorney, Gerald Bell. Hon. W. David Denton and Hon. Stacey Blankenship represented Complainants, Chief Redell Benton and the City of Paducah. Hon. Tom Osborne was legal advisor to the Board of Commissioners. Detailed testimony was taken by court reporter Elizabeth Hausman. Mr. Denton gave a summary of the charges against Mr. York and informed the Commission an agreement had been reached between the parties whereby Mr. York had pled guilty and admitted to all charges set forth in the Statement of Charges and was requesting that the Commission set his discipline. C: � The Commission requested that certain witnesses be called before they reached their decision. Reporter Elizabeth Hausman swore in the following witnesses: Chief Redell Benton Jason York The Notice of Hearing and Statement of Charges were entered into evidence as Exhibit "A" by stipulation of all parties. A Stipulation concerning Firefighters James Cannon and David Denton was entered into evidence by as Exhibit `B" by stipulation of all parties Mr. Denton presented his opening statement. Mr. Bell presented his opening statement and agreed to the factual allegations in the Statement of Charges. EXECUTIVE SESSION Commissioner Coleman offered motion, seconded by Commissioner Smith, that the Board go into closed session to hear mitigation of circumstances in this case. Adopted on call of the roll, yeas, Commissioners Coleman, Paxton, Smith, Wrye and Mayor Jones (5). At the conclusion of the closed session the Board reconvened in open session, whereupon the Mayor called the meeting back to order. MOTION FOR CLOSED HEARING Mayor Jones offered motion that the hearing be conducted in closed session. Lost on call of the roll, nays, Commissioners Coleman, Paxton, Smith, Wrye and Mayor Jones (5). 203 �... .._ ...._.. _.. ,..,....bad. `J Mr. Denton told the Commission that the defendant pled guilty to charges and no case would be presented. Mr. Bell confirmed Mr. Denton's statement that the respondent acknowledged the factual allegation in the Statement of Charges and pled guilty, but that the respondent did not acknowledge injuring or skinning Mr. Holt's knee and leg at the jail. The Commission again stated they wanted to hear more evidence in this case. At this time it was stipulated by both parties that Exhibit "C" be admitted into evidence. This was an application for a hardship driver's license by the respondent. Direct examination was conducted by Mr. Denton and cross examination was conducted by Mr. Bell on the following witnesses: Chief Redell Benton Respondent Jason York Charles Holt, Jail Supervisor, was called and sworn in as a witness at this time and given direct examination by Ms. Blankenship and cross examined by Mr. Bell. Officer Kingston was called and sworn in as a witness and given direct examination by Ms. Blankenship and cross examined by Mr. Bell. Mr. Denton presented his closing statement. Mr. Bell presented his closing statement. Commissioner Smith offered motion, seconded by Commissioner Wrye, that the Board of Commissioners go into closed session to discuss issues which might lead to the dismissal ✓ or disciplining of Mr. York, as permitted by KRS 61.810(10(f). Adopted on call of the roll, yeas, Commissioners Coleman, Paxton, Smith, Wrye and Mayor Jones (5). At the conclusion of the executive session the Board reconvened in open session, whereupon the Mayor called the meeting back to order. MOTION TO TERMINATE Commissioner Smith offered motion, seconded by Commissioner Wrye, that Jason York's employment with the City of Paducah be terminated pursuant to the statement of charges. Adopted on call of the roll, yeas, Commissioners Coleman, Paxton, Smith, Wrye and Mayor Jones (5). Upon motion the meeting adjourned.
