AN ORDINANCE AMENDING SECTION 2-21 "VACATION LEAVE
GENERALLY" OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH,
KENTUCKY
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That Section 2-21 "Vacation leave generally" of the
Code of Ordinances of the City of Paducah, Kentucky, be amended, and reordained
so that said section as amended and reordained shall hereafter read as follows:
"Sec. 2-21. Vacation leave generally.
(a-1) All present employees shall continue to receive _vacation at the rate
of one and one-fourth (1-1/4) days of vacation for each month of employment with
the city except for those employees who have begun their fifteenth year of service
with the city who shall receive vacation at the increased rate as hereinafter set forth.
Except for members of the Police and Fire Departments, all employees employed after
the date of March 31, 1976, shall receive vacation time as follows: During the first
year of employment, vacation time shall accrue at the rate of one-half (1/2) day per
month fora total of six days. Between the beginning of the second and the beginning
of the fifth year of employment, employees shall accrue vacation at the rate of five -
sixth (5/6) days per month, for a total of ten (10) days per year. From the beginning
of the fifth (5) year to the beginning of the tenth (10) year of employment, the accrual
rate shall be one (1) day per month for a total of twelve (12) days per. year. Between
the beginning of the tenth (10) year and the beginning of., the fifteenth _(15) year of
service,
the accrual
rate shall
be one and one-fourth
(14) days_ per month
for a
total
of fifteen
(15) days
per year.
Between the beginning
of the fifteenth (15)
year
and the
beginning of the twentieth (20) year of service, the accrual rate shall be one and one-
half (12) days per month for a total .of eighteen (18) days vacation per year. From
the beginning of the twentieth (20) year through the twenty-fifth. (25) year of service,
the accrual rate of vacation will be one and three-fourths (1-3/4) days per month for,
a total of twenty-one (21) days per year. For all employees with more than, twenty-
five (25) years of service, the accrual rate of vacation shall be two (2). days per
month for a total of twenty-four (24) days per year. An employee may accumulate
up to a maximum of fifty (50) .days vacation , at any one time. Upon termination of
employment, all employees shall be paid for any unused accrued vacation leave not
to exceed fifty (50) working days."

After obtaining vacation eligibility, an employee may take vacation as may
be reasonably scheduled with his department head as hereinafter set forth in sub-
section (f), or in the case of a department head, as may be scheduled with the
City Manager. A month in which a salaried employee is paid for fifteen (15) days
or more
and a daily
or hourly
wage employee is paid for twelve (12) days or more
shall be
considered
as a month
of service.
(a-2) All present members of the Police Department shall continue to
receive vacation at the rate of one and one-quarter (14) days of vacation for each
month of employment with the City for a total of fifteen (15) days per year, except
for those members who have begun their fifteenth (15) year of service with the
City who shall receive vacation at the increased rate as hereinafter set forth. All
members employed after June 30, 1980 shall receive vacation time as follows: during
the first fourteen (14) years of employment, vacation time shall accrue at the rate
of one and one-quarter (14) days per month for a total of fifteen (15) days per
year. Between the beginning of the fiftheen (15) year and the beginning of the
twentieth (20) year, members shall accrue vacation at the rate of one and one-half
(12) days per month for a total of eighteen (18) days per year. From the beginning
of the twentieth (20) year to the beginning of the twenty-fifth (25) year of employ-
ment, the accrual rate shall be one and three -fourth (1 3/4) days per month for
a total of twenty-one (21) days per year. For all members with more than twenty-
five (25) years of service, the accrual rate for vacation shall be two (2) days per
month for a total of twenty-four (24) days per year. Each member may accrue up
to a maximum of fifty (50) days of vacation at any one time.
(a-3) Members of the Fire Department working shifts of twenty-four (24)
hours on duty and forty-eight (48) hours off duty which have less than fifteen (15)
years of continuous service with the department, and were with the department
prior to July 1, 1980 shall accrue vacation at the annual rate of six (6) work days;
all other members of the fire department working shifts of twenty-four (24) hours
on duty and forty-eight (48) hours off duty shall accrue vacation as follows:
Members which have less than three (3) years service with the department, at the
annual rate of four (4) work days; members which have successfully completed
more than three (3) years but less than ten (10) years service with the department,
at the annual rate of five (5) working days; members which have successfully
completed more than ten (10) years but less than fifteen (15) years service with the
department, at the annual rate of six (6) working days; members which have success-

fully completed more than fifteen (15) years but less than twenty (20) years service
with the department, at the annual rate of seven (7) working days; members which
have successfully completed more than twenty (20) years but less__than_twenty-five
(25) years service with the department, at the annual rate of .eight (8) working 'days;
and members which have successfully completed more than twenty-five (25) years
of service with the department, at the annual rate of nine (9) working days. A
work day as used in this section shall mean a twenty-four (24) hour period. Such
vacation shall be taken with the approval and consent of the Fire Chief. Vacation
pay shall be computed at the average pay the employee would receive for the period
of time covered by the vacation based on an average work week of fifty-six (56)
hours. Each member may accrue up to a maximum of twenty-five (25) days of
vacation at any one time.
(a-4) Members of the Fire Department not included in Section 2-21 (a-3)
of this code shall receive the same vacation accrual as the employees of the City
who are not members of the Police and Fire Departments. No member of the Fire
Department shall receive an accrual rate for vacation then that member had on
June 30, 1980 as a result of the changes in vacation accrual effective July 1, 1980.
(b) An employee may be advanced the number of days of vacation leave
that would be earned during the remainder of the current calendar year, but if an
employee is separated from employment before such advance leave is accrued under
this section, the employee shall reimburse the city for the amount of unaccrued leave
that was taken, and for this purpose a deduction shall be made from the employee's
final payroll check.
(c) Regular full-time employees paid on an hourly wage basis shall
receive vacation pay at their regular hourly rates for the number of hours in their
regular daily shifts for each working day while on vacation leave.
(d) Upon termination of employment, all employees except those governed
by the collective bargaining agreement between the city and Firefighters' Local 168
shall be paid for any unused accrued vacation leave not to exceed fifty (50) working
days.
(e) An employee granted a leave of absence with pay for any purpose
shall continue to accrue vacation leave at the rate prescribed in this section
during such absence.
(f) Each department head shall prepare a schedule of vacations for
the entire year indicating how many employees may be gone from work within the
department at any one time, and requests for vacation shall be applied for on a
basis of seniority during the month of January of each year. Accrued time not
