HomeMy WebLinkAbout80-5-1913630 1� ORDINANCE NO. 80-5-1913 AN ORDINANCE ACCEPTING THE NEGOTIATED CONTRACT WITH JIMAR PAVING COMPANY FOR SALE TO THE CITY OF PADUCAH OF IT'S REQUIREMENT OF BITUMINOUS CONCRETE '(CLASS - 1, TYPE Aj TO' 13E USED 1N STREET RESUR- FACING, AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT FOR SUCH PURCHASE WHEREAS, by Resolution adopted by the Board of Commissioners on April -22, 1980, the City of Paducah advertised for it's requirement of bituminous concrete (Class 1, Type A) for the year 1980; and WHEREAS, the City Engineer 'determined that all of the bids received were unresponsive to the specifications in that specifications required that the price be guaranteed for one year, and all of the bids received, would not guarantee price for one year, and WHEREAS, the City Engineer, under the provisions of the Kentucky Procurement Code, entered into competitive negotiations with the responsive bidders, and WHEREAS, `the best terms for the purchase of bituminous concrete (Class 1, Type A) , has been negotiated between the. City Engineer, and Jimar Paving Company. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah accept the negotiated contract with Jimar Paving Company for sale to th'e'City of it's requirements of bituminous con- crete (Class 1, Type A) for the year 1980 (approximately 5,000 tons) for the sum of $20.00 per ton (said price to be guaranteed through October 15, 1980, after which it may be adjusted) to be picked up at the plant by the City, and to be used in street resurfacing, said contract being in substantial compliance with the negotiated bid specifications. SECTION 2. That the City Manager be, and he is hereby, authorized to execute a contract with Jimar Paving Company for sale to the City of ,.the material authorized in. Section 1 above, according to the negotiated specifications above, bid proposal and all contract documents heretofore .approved and incorporated in the negotiated bid. SECTION 3. The purchase price for said material shall be charged to either General Fund or Federal Revenue Sharing Account No. 3454. 631 SECTION 4. This ordinance shall be introduced and remain on file for one week for public inspection in the completed form in which it shall be put upon its final passage, and if adopted shall be in full force and effect ten (10) days thereafter.
