HomeMy WebLinkAbout2015-03-8227196 ORDINANCE NO. 2015-3-8227 AN ORDINANCE OF THE CITY OF PADUCAH, KENTUCKY AUTHORIZING THE MAYOR TO EXECUTE AMENDMENT NO. 1 TO THE DESIGN AGREEMENT WITH THE DEPARTMENT OF THE ARMY, REPRESENTED BY THE DISTRICT ENGINEER, U.S. ARMY ENGINEER, LOUISVILLE DISTRICT FOR DESIGN FOR THE OHIO RIVER SHORELINE, PADUCAH, KENTUCKY RECONSTRUCTION PROJECT WHEREAS, by Ordinance No. 2013-2-8014, the City of Paducah, Kentucky, entered into a design agreement with the Department of the Army, for the Ohio River Shoreline, Paducah, Kentucky LFPP Reconstruction Project; and WHEREAS, the agreement consisted of the Peconstruction Engineering and Design (PED) activities associated specifically with Priority #1 - Pump Station Rehab portion of the Levee System Reconstruction Project; and WHEREAS, with the design of the 1 st Priority well underway, the Army wishes to amend the current Design Agreement to include the remaining Priorities of the Paducah Levee System Reconstruction Project, which consists of Priority #2 - Priority #7. The Priorities are as follows: Priority #I Pump Station Rehab Priority #2 Flap Gates Priority #3 Seal Closures Priority #4 Gate Wells Priority #5 T -Wall, Toe Drain, Water Stops, Misc. Priority #6 New Pump Station #14 Priority #7 I -Wall Investigation, Analysis, Remediation WHEREAS, this agreement obligates the City to contribute 35 percent (35%) of the total design costs associated with the Reconstruction Project, which is projected to be approximately $2,281,925.00. Therefore, the City's approximate share for the design of the Reconstruction Project is estimated to be $798,674.00 total. Part of this amount can be credited by in-kind services by City staff and /or city expenditures/resources required; and WHEREAS, it is in the best interest of the City to agree to this amendment as offered by the Department of the Army. KENTUCKY: NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH, SECTION 1. That the Mayor is hereby authorized to execute Amendment No. 1 to the Design Agreement between the Department of the Army, and the City of Paducah, Kentucky, for design for the Ohio River Shoreline, Paducah, Kentucky, Reconstruction Project. SECTION 2. Funds shall be appropriated from project account FW006. SECTION 3. If any section, paragraph or provision of this Ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such section, paragraph or provision shall not affect any of the remaining provisions of this Ordinance. SECTION 4. The City Commission hereby finds and determines that all formal actions relative to the adoption of this Ordinance were taken in an open meeting of this City Commission, and that all deliberations of this City Commission and of its committees, if any, which resulted in formal action, were in meetings open to the public, in full compliance with applicable legal requirements. SECTION 5.
