HomeMy WebLinkAbout80-2-1867522 ORDINANCE NO. 80-2-1867 AN ORDINANCE AUTHORIZING THE USE AND OPERATION OF COIN OPERATED AMUSEMENT MACHINES AND POOL AND BILLIARD TABLES ON SUNDAY AFTERNOONS WHEREAS, KRS 436.160 sets forth a general prohibition which precludes the engagement or employment in occupations on Sundays, and WHEREAS, KRS 436.165 provides that the legislative body of a city may, by ordinance, permit and regulate activities on Sundays within its jurisdictional boundaries, and WHEREAS, the Board of Commissioners of the City of Paducah deem it appropriate to authorize and permit the engagement or employment in occupations on Sunday, which occupations pertain to the use and operation of coin operated amuse- ment machines, pool tables and billiard tables. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. It shall be lawful for any person to hold out for public use and operation coin operated amusement machines, pool tables of any type and bil- liard tables of any type on Sundays. Coin operated amusement machines shall be defined to include coin operated pin ball machines, video playing machines, air hockey machines, billiard tables of any type, pool tables of any type, foot ball machines and other coin operated amusement machines of a like nature. SECTION 2. Notwithstanding such authorization, no coin operated amusement machine or billiard table or pool table shall be held out for public use on Sunday between the hours of 6:00 o'clock A.M. and 12:00 o'clock noon. SECTION 3. Notwithstanding the above authorization, no business shall be authorized to operated on Sunday who has been granted a license for sale at re- tail, of alcoholic liquor or beverages. SECTION 4. Notwithstanding Section 1, 2, and 3 of this Ordinance, all Sunday activities allowed by this ordinance shall be subject to the following limitations: (a) No employer shall require, as a condition of employment, that any employee work on Sunday or on any other day of the week which any such employee may conscientiously wish to observe as a religious Sabbath. (b) No employer shall in any way discriminate in the hiring or retaining of employees between those who designate a Sabbath as their day of rest and those -who do not make such designation, provided, however, that the payment of premium or overtime wage rates for Sunday employment shall not be deemed discriminatory. 523 (c) Every employer engaged in Sunday activities shall allow each person employed by him in connection with such business or service, at least twenty-four (24) consecutive hours of rest in each calendar week in addition to the regular periods of rest. normally 'allowed or legally required in each working day. (d) Every business authorized by Section 1 of this Ordinance shall not allow intoxicated persons on said premises nor allow any person to posses alcoholic beverages on the premises. (e) Every business allowed by Section 1 of this Ordinance shall have a person in charge on the premises during all hours which said busi- ness is operating on Sunday, and said person shall be at least 18 years of age. SECTION 5. Violation of any Section of this Ordinance shall be 'deemed to be guilty of a Class B misdemeanor, and shall be punishable by a fine not to exceed $250.00 or confinement in the county jail for a term not to exceed ninety (90) days. entirety. SECTION 6. That Ordinance No. 8'0-1-1840 is hereby repealed in its SECTION 7. This ordinance shall be introduced and remain on file for one week for public inspection in the completed form in which it shall be put upon its final passage, and if adopted shall be in full force and effect ten (10) days thereafter .
