HomeMy WebLinkAbout2010-2-7653ORDINANCE NO. 2010-2-7653 AN ORDINANCE ACCEPTING THE REVISED BID OF M P LAWSON CONSTRUCTION FOR THE PAVILION PROJECT PHASE 11, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME WHEREAS, pursuant to Sec. 2-645 of the Code of Ordinances of the City of Paducah, Kentucky, the City received sealed bids on January 22, 2010, for the Pavilion Project Phase II in the amount of $673,695.00; and WHEREAS, pursuant to Sec. 2-650(e) and 2-654(4) of the Code of Ordinances of the City of Paducah, Kentucky, a written determination has been made by the City Manager that the bids were rejected for the following reasons: a) the bids received are unreasonable in price; b) that there are no additional funds available from any source so as to permit an award to the lowest responsive and responsible bidders; and c) the best interest of the City will not permit the delay attendant to a re -solicitation under revised specifications or revised quantities under competitive sealed bidding; and WHEREAS, the City changed the scope of the project to remove the portable floor from Phase III and instead install a concrete floor in Phase 11 along with other changes including electrical adjustments and changes to the site drainage and sidewalks; and WHEREAS, the City went into competitive bid negotiations with the three responsive and responsible bidders and a revised bid was obtained. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The City of Paducah accepts the revised bid of M P Lawson Construction for the Pavilion Project Phase II in the amount of $694,396.00. Said contract is in substantial compliance with the revised bid specifications and bid of M P Lawson Construction dated February 1, 2010. SECTION 2. The Mayor is hereby authorized to execute a contract between the City of Paducah and M P Lawson Construction for the Pavilion Project Phase II as set out in Section 1 above. SECTION 3. This expenditure shall be charged to PA0086 account. SECTION 4.
