HomeMy WebLinkAbout10/20/09OCTOBER 20, 2009 At a Regular Meeting of the Board of Commissioners, held on Tuesday, October 20, 2009, at 5:30 p.m., Mayor Paxton presided, and upon call of the roll by the City Clerk, the following answered to their names: Commissioners Abraham, Kaler, Watkins and Mayor Paxton (4). Commissioner Gault was absent (1). Commissioner Kaler talked about the Commissioners' neighborhood stroll in Wallace Park Subdivision on Saturday. She said it was a very good event. Janice Cromwell, resident of Wallace Park, called her to say thank you. One of the issues discussed during the event was the proposed building of a bank bordered by Lone Oak Road, Alben Barkley Drive and Forrest Circle. The neighborhood really enjoyed the Commissioners coming out to stroll their neighborhood. PUBLIC HEARING PROPERTY TAX Mayor Paxton declared the Commission was going into a Public Hearing for Property Tax Levy. At this time the public is welcome to make any comments regarding the property tax levy. Jon Perkins, Finance Director, reported that the property tax levy in 1995 was almost $.44 per $100. It started decreasing in 1997and has been steadily decreasing since that time. The rate has been at $.25 per $100 since 2008 and Mr. Perkins and staff recommend that the rate stay the same. This will be the third year it has held at $25 per $100. Conrad Rayberg was upset that he was not given a handout of the material being explained to the Commission. Mayor Paxton asked Adrienne Gleeson, Budget and Human Resources Administrator in the Finance Department, to get a copy of the material and explain it to Mr. Rayberg and answer any questions he may have. There was no further comments from the public. Mayor announced the Public Hearing was closed. WORKSHOP EXPENDABLE FUND BALANCE Jon Perkins distributed a General Fuad Fund Balance report to the Board. He reported that the expendable fund balance is $1,265,000. This amount is determined once the books are closed the previous year. Should there be an.,amount over the legal mandate of a city retaining an 8% reserve based on the current year's appropriations. The City is allowed to choose how to use it. The following recommendations have been made: Put aside $510,000 in anticipation of the IAFF lawsuit attorney cost and the Police and Fire Pension Fund. It is recommended that $176,000 be restored to the Commission Contingency bringing the total to the original up to $300,000. $400,000 should be set aside to be used if there is a settlement for the IAFF OT lawsuit. This leaves a balance of $176,000. Mr. Perkins recommends the balance go to public safety such as police and fire. He has asked the chiefs to review their original requests priorities, see if there are any changes, and then let him know. Once this is done he will bring the recommendations back to the Board and ask for approval. Mayor asked the Commission if they have any questions or comments to get with the City Manager. SIDEWALK PLAN STUDY In 2008, the City Commission assigned the task of creating a comprehensive sidewalk plan for the City to the Planning Department. Steve Ervin, Director of Planning, reported that the study is now complete. Once the project started they decided to divide the study into two parts, "The Comprehensive Sidewalk Plan" and the "Comprehensive Greenway Plan." The task was then assigned to City Planner, Ben Petersen. Mr. Petersen gave a summary of the 2009 City of Paducah Sidewalk Study. A copy of the study is in the minute file and is posted on the City's website. Once the study has been reviewed and edited the Planning Department will ask the Commission to adopt the study as part of the Comprehensive Plan for the City. TREE PRESERVATION ORDINANCE Steve Ervin gave a brief presentation on the above ordinance. The purpose of the ordinance is to protect, preserve and promote the City of Paducah tree canopy. This ordinance applies to private property within the City limits that is over 1 acre and the diameter of the tree is over 18". In the ordinance it states that "no tree shall be cut or otherwise removed from any land that is to be developed for new commercial or residential development in the City with out a tree removal permit". Exemptions that apply to this plan include cemeteries, commercial nurseries, and residential lots less than one acre. Mr. Ervin asked if the Commission had any revisions to the plan, if not he will move forward with the ordinance and prepare it for Commission action. OCTOBER 20, 2009 MUNICIPAL ORDER TRANSFER FUNDS FROM COMMISSION CONTINGENCY TO SPORTS PARK PROJECT ACCOUNT Commissioner Abraham offered motion, seconded by Commissioner Gault, that a Municipal Order entitled, "A MUNICIPAL ORDER AUTHORIZING AND DIRECTING THE FINANCE DIRECTOR TO TRANSFER $55,000.00 FROM THE COMMISSION CONTINGENCY ACCOUNT TO THE SPORTS PARK MASTER PLAN PROJECT ACCOUNT FOR PREPARATION OF A MASTER PLAN AND PROPERTY APPRAISAL FOR A SPORTS PARK TO BE LOCATED ON SHEEHAN BRIDGE ROAD IN MCCRACKEN COUNTY," be adopted. Adopted on call of the roll, yeas, Commissioners Abraham, Gault, Kaler, Watkins and Mayor Paxton (5). M.O.#1489; BK 8; PG ORDINANCE — ADOPTION PROPERTY TAX LEVY Commissioner Gault offered motion, seconded by Commissioner Abraham, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE FIXING THE LEVIES AND RATES OF TAXATION ON ALL PROPERTY IN THE CITY OF PADUCAH, KENTUCKY, SUBJECT TO TAXATION FOR MUNICIPAL PURPOSES AND FOR SCHOOL PURPOSES FOR THE PERIOD FROM JULY 1, 2009, THROUGH JUNE 30, 2010, WITH THE PURPOSES OF SAID TAXES HEREUNDER DEFINED." ORD.#2009-10-7615; BK 32; PG ORDINANCES — INTRODUCTION CONTRACT FOR SOCCER PARK MASTERPLAN Commissioner Kaler offered motion, seconded by Commissioner Watkins, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH BRANDSTETTER CARROLL, INC. FOR PROFESSIONAL SERVICES ASSOCIATED WITH THE PROPERTY LOCATED ON SHEEHAN OCTOBER 20, 2009 BRIDGE ROAD BEING CONSIDERED FOR THE DEVELOPMENT OF A SPORTS PARK". This ordinance is summarized as follows: That the Mayor of the City of Paducah is hereby authorized to execute an Agreement with Brandstetter Carroll, Inc., in the amount of $50,000.00 for professional services to perform a site evaluation and master plan for the property located on Sheehan Bridge Road being considered for the development of a Sports Park. APPROVE SOLE SOURCE PURCHASE OF TASERS FOR POLICE DEPARTMENT Commissioner Watkins offered motion, seconded by Commissioner Kaler, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING THE FINANCE DIRECTOR TO PAY FOR THE SOLE SOURCE PURCHASE OF TASERS AND ACCESSORIES FOR THE PADUCAH POLICE DEPARTMENT AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME." This ordinance is summarized as follows: That the City of Paducah hereby authorizes the Finance Director to make payment to TASER International, in the amount of $43,337.06, for purchase of 50 tasers along with holsters, batteries, and cartridges for use by the Paducah Police Department, and authorizes the Mayor to execute a contract for same. Funds received from the Justice Assistance Recovery Grant will be used for the purchase. CITY MANAGER REPORT ❖ Calendar Items ❖ Rick Murphy along with Kathleen Lake, associate of JJR gave a status update for the Riverfront Development Project. The finding of mussels nearly a year ago in the Ohio River has held up the project. Lake says a biological assessment and environmental assessment will be submitted October 31. The next step is for the U.S. Fish and Wildlife to issue a biological opinion regarding the mitigation of the mussels. Murphy and Lake expect the removal of the mussels to begin next summer in addition to the initial construction of the expansion of Schultz Park. The engineering design is also being finalized for the riverfront area that includes the expansion of Schultz Park and the construction of a transient dock and floating marina services building. ❖ Personnel Actions — No discussion ❖ City Manager requested an executive session for possible property acquisition and three economic development opportunities. EXECUTIVE SESSION Commissioner Abraham offered motion, seconded by Commissioner Gault, that the Board go into closed session for discussion of matters pertaining to the following topics: ❖ Future sale or acquisition of a specific parcel(s) of real estate, as permitted by KRS 61.810(1)(b). ❖ A specific proposal by a business entity where public discussion of the subject matter would jeopardize the location, retention, expansion or upgrading of a business entity, as permitted by KRS 61.810(1) (g).
