HomeMy WebLinkAbout2009-8-7602ORDINANCE NO. 2009-8-7602 AN ORDINANCE PROVIDING FOR THE CLOSING OF A PORTION OF LINDSEY STREET, A PORTION OF A 15' WIDE ALLEY, AND A PORTION OF AN 18' ALLEY BEING LOCATED BETWEEN NORTH 20TH STREET AND NORTH 21sT STREET AND NORTH OF PARK AVENUE BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah does hereby authorize the closing of a portion of Lindsey Street, a portion of a 15' wide alley, and a portion of an 18' alley being located between North 20th Street and North 21St Street and North of Park Avenue, and being more particularly described as follows: DESCRIPTION OF A PORTION OF LINDSEY STREET TO BE CLOSED AND VACATED A tract of land lying approximately 320 feet east of the easterly right-of-way margin of 21St. Street and approximately 465 north of the northerly line of an 18 foot wide public alley and adjacent to 20th Street Closed in the City of Paducah, McCracken County, Kentucky being more particularly described as follows: Beginning at a point where the westerly right-of-way margin of 20th Street Closed (Unimproved) (50' R/W) (25' from centerline) and the northerly right-of-way margin way of Lindsey Street (Unimproved) intersects as shown on Whittemores North Side Addition to The City of Paducah of record in Plat Book A, Page 82 McCracken County Court Clerk's Office; thence with the westerly right-of-way margin of 20th Street Closed, South 05 degrees 23' 22" West 50.02 feet to a point at the intersection of the southerly right-of-way margin of Lindsey Street and the westerly right-of-way margin of 20th Street; thence leaving the westerly right-of-way margin of 20th. Street and with the southerly right-of-way margin of Lindsey Street North 86 degrees 20'39" West, 158.99 feet to the intersection of the southerly right-of-way margin of Lindsey Street and the easterly right-of-way margin of a 15 foot wide alley; thence with the easterly right-of-way margin of a 15 foot wide alley North 03 degrees 39'21" East 50.00 feet to a point at the intersection of the northerly right-of-way margin of Lindsey Street and the easterly right-of-way margin of a 15 foot wide alley; thence leaving the easterly right-of-way margin of a 15 foot wide alley and with the northerly right-of-way margin of Lindsey Street South 86 degrees 20'39" East 160.50 feet to the point of beginning containing 0.1834 Acres or 7,987.3 square feet. Subject property being the portion of Lindsey Street that lies east of a 15 foot wide alley and west of 20th Street Closed as shown on Whittemores North Side Addition to The City of Paducah of record in Plat Book A, Page 82 McCracken County Court Clerk's Office. DESCRIPTION OF A PORTION OF A 15' WIDE ALLEY AND A PORTION OF AN 18' ALLEY TO BE CLOSED AND VACATED A tract of land lying approximately 145 feet north of the northerly right-of-way margin of Park Avenue and 30 feet east of the centerline of 21 St. Street in the City of Paducah, McCracken County, Kentucky being more particularly described as follows: Beginning at a 1/2" iron rebar w/cap (fnd) PLS #1955 at the intersection of the easterly right-of-way margin of 21 St. Street and the southerly right-of-way margin of a 18 foot wide alley as shown on Whittemores North Side Addition to The City of Paducah of record in Plat Book A, Page 82 McCracken County Court Clerk's Office; thence with the easterly right-of-way margin of 21 St. Street North 03 degrees 39'21 " East 18.00 feet to a point at the intersection of the easterly right-of-way margin of 21 St. Street and the northerly right-of-way margin of a 18 foot wide alley; thence leaving the easterly right-of-way margin of 21 St. Street and with the northerly right-of-way margin of a 18 foot wide alley South 86 degrees 20'39" East 145.00 feet to the intersection of the northerly right-of-way margin of a 18 foot wide alley and the westerly right-of-way margin of a 15 foot wide alley; thence with the westerly right-of-way margin of a 15 foot wide alley North 03 degrees 39'21" East, 80.00 feet to a point; thence severing said 15 foot wide alley South 86 degrees 20'39" East 15.00 feet to a point in the easterly line of the 15 foot wide alley; thence with the easterly right-of-way margin of said 15 foot wide alley, South 03 degrees 39'21 " West 80.00 feet to a point where the easterly right-of-way margin of the 15 foot wide alley intersect the northerly right-of-way of a 18 foot wide alley; thence with the northerly right-of-way margin of the 18 foot wide alley South 86 degrees 20'39" East 145.67 feet to a point in the westerly right-of-way margin of 20th Street Closed; thence with the westerly right-of-way margin of 20th Street Closed South 05 degrees 23'22" West 18.00 feet to point at the intersection of the southerly right-of-way margin of the 18 foot wide alley and the westerly right-of-way margin of 20th Street Closed; thence leaving the westerly right-of-way margin of 20th Street Closed and with the southerly right-of-way margin of the 18 foot wide alley North 86 degrees 20'39" West 305.13 feet to the point of beginning, containing 0.1538 Acres or 6,697.2 square feet. Subject property being all of a 18 foot wide public alley and a portion of a 15 foot wide alley in Block 2, as shown on Whittemores North Side Addition to The City of Paducah of record in Plat Book A, Page 82 McCracken County Court Clerk's Office. SECTION 2. In support of its decision to close the aforesaid public way, the Board of Commissioners hereby makes the following findings of fact: a. Robert B. Vanzant, Marianna Vanzant, April Vanzant, and the City of Paducah, are the owners of property abutting the public way which the Board of Commissioners has authorized to be closed as is evidenced by the application for street and/or alley closing which is attached hereto and made part hereof. b. On the 20th day of July 2009, the Paducah Planning Commission of the City of Paducah adopted a resolution recommending to the Mayor and Board of Commissioners of the City of Paducah closure of the aforesaid public way. Written notice of the proposed closing was given to all property owners in or abutting the public way or the portion thereof being closed as is evidenced by the application for street and/or alley closing which is attached hereto and made a part hereof. d. All property owners in or abutting the public way or the portion thereof being closed have given their written notarized consent to the closing as is evidenced by the application for street and/or alley closing which is attached hereto and made a part hereof. SECTION 3. All requirements of KRS 82.405(1) and (2) having been met, the Board of Commissioners of the City of Paducah hereby concludes that the aforesaid public way, as described above, should be closed in accordance with the provisions of KRS 82.405. SECTION 4. The Mayor is hereby authorized, empowered, and directed to execute a quitclaim deed from the City of Paducah to each of the property owners in or abutting the public way to be closed with each to acquire title to that portion of the public way contiguous to the property now owned by said property owners up to center line of the said public way. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. �TTEST: S /3/Z&t& Tammara S.
