HomeMy WebLinkAbout78-11-16501043 ORDINANCE NO. 78-11-1650 AN. ORDINANCE GRANTING A FRANCHISE- TO BROWNING -FERRIS INDUSTRIES OF INDIANA, INC. TO OPERATE AND _MAINTAIN A SOLID WASTE COLLECTION SYSTEM WITHIN THE CORPORATE LIMITS OF THE CITY OF PADUCAH, KENTUCKY AND ,AUTHORIZING THE MAYOR TO EXECUTE THE ,_FRANCHISE AGREEMENT WHEREAS, bids were received by the City of .Paducah, Kentucky on November 7, 1978 from firms interested _in operating and maintaining a solid waste collection system within the City and, WHEREAS, Browning-Ferris Industries; of Indiana, Inc. submitted a bid which the Board deems superior and in the best interest of the City, and WHEREAS, the City and Browning-Ferris have substantially agreed upon the terms, provisions and contents to be contained in a franchise agreement, and the Board of Commissioners is satisfied there exist no just or valid reason to delay the awarding of the aforesaid franchise. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH , KENTUCKY: SECTION 1. There .is hereby granted by the City of Paducah, Kentucky, to Browning-Ferris Industries of Indiana, Inc. the right and privilege to operate and maintain, in, upon, along, across and over the streets, public ways and public places located within the corporate limits of the City, a solid waste collection system which shall serve all customers of the City with the exception of those that are currently being served by City approved private collection systems. SECTION 2. The right to operate and maintain the aforesaid solid waste collection system shall at all times be subject to the provisions as set forth in a franchise agreement, including any approved amendments thereto between the City and Browning-Ferris. SECTION 3. The Mayor is hereby authorized by and upon behalf of the City to execute this franchise agreement with Browning-Ferris; said agreement to contain substantially the terms and provisions as more particularly set forth in the specifications, promulgated by the City of Paducah in requesting the aforementioned bids and as contained in the bid of Browning-Ferris, dated November 6, 1978. SECTION 4. The City Clerk is hereby directed to have this ordinance published in the manner prescribed by law in the local newspaper of general circulation. 1044 SECTION 5. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph, and provision hereof separable from all other sections, paragraph and provisions. SECTION .6. 'This ordinance shall be introduced and remain on file for one week for public inspection in the completed form in which it shall be put upon its final passage, and if adopted shall be in full force and effect ten (10) days thereafter.
