WHEREAS , on November 14, 1978 the Board of Commissioners approved an ordinance amending water rates in and outside of the City of Paducah, and WHEREAS , said rates were approved to allow the Commissioners of Water Works to proceed with building anew water treatment plant, and WHEREAS, the Paducah Code of Ordinances, Section 32-25, authorizes the Commissioners of Water Works to control and manage the water system of the City, and ~. ,. _.: ., ,r_~ WHEREAS, the Code of Ordinances of the City of Paducah, Section 32-29, gives the Commissioners of Water Works the obligation of recommending to the Board of Commissioners the rates to be charged for water, and WHEREAS, the Board of Commissioners on July 24, 1979, approved a study by Black & Veatch to look into the need and alternatives to constructing a new water treatment plant, and WHEREAS , several county water districts have filed suit against the City of Paducah and the Commissioners of Water Works , alleging that the rate increases violate the contract between the aforesaid water districts , the City of Paducah and the Commissioners of Water Works . NOW , THEREFORE , BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Board of Commissioners request that the Commissioners _. _. ,. of Water Works not expend'"any additional monies on the development of a new water treatment plant until such time as the report of Black & Veatch is received by the Board of Commissioners, and they have had sufficient time to review said report and make recommendations to the Commissioners of Water Works . SECTION 2. The City Clerk is instructed to forward a copy of this resolution to each Commissioner of Water Works . SECTION 3. This resolution shall be in full force and effect from and after the date of its adoption .
