HomeMy WebLinkAbout79-6-1737211 2 ORDINANCE NO. 79-6-1737 AN ORDINANCE PROVIDING FOR THE CLOSING OF AN ALLEY LYING BETWEEN SEVENTH AND EIGHTH AND CALDWELL AND NORTON STREETS, SUBJECT TO THE GRANTING OF AN EASEMENT AS IS SATISFACTORY WITH THE CITY ENGINEER FOR A STORM SEWER BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah does hereby authorize- the closing of an alley lying between Seventh and Eighth and Caldwell and Norton Streets, sub- ject to the granting of an easement as is satisfactory with the City Engineer for a storm sewer, and more particularly described as follows: Beginning at the northeast corner of Tract I conveyed to Drew and Robertson by deed of Rhodes, et al . , . dated March, 2., 1978, recorded in Deed Book 603, page 231, Office of the McCracken County Court Clerk,_ which point of beginning is the intersection of the westerly line of South Seventh Street and the southerly line of the alley described herein, and which point of beginning is one hundred fifty (150) feet, more or less, from the intersection of the northerly line of Caldwell Street, .and. westerly line .of South Seventh Street, thence westerly and with the southerly line of said alley and the northerly line of Tracts .I, II, . and III of Drew and Robertson. as con- veyed to them in the aforesaid deed, and also with the northerly line of 707 Caldwell and 709 Caldwell conveyed to Drew and Robertson by deed of Dalton Woodall, Master Commissioner, on behalf of Leslie McClure, et al. ,, dated November 1,_ 1978,,, recorded in Deed Book 611, -page .58.3, aforesaid Clerk's office'; two. hundred. (200) feet, more or less to the northwest corner 'of said :lot known as 709 Caldwell Street; thence, in a northerly, direction. and with ,the westerly line of said 709 Caldwell. Street, if extended, 19 feet 9 inches more or less, to the southerly line of E . M . Bailey Distribution Company_,. as described in deed dated December. 19,. 1974, recorded in Deed Book 568, page 558, aforesaid .Clerk's office; which also is the northerly line of the herein described alley,, thence easterly. and with said southerly line of Bailey two` hundred (200) feet,. more or less, to, the westerly line of South Seventh _.Street; thence southerly and with the westerly line of South Seventh Street, 19 feet-, 9 inches, more or less, to the point of beginning.;._ , SECTION 2. That the Corporation Counsel of the City of Paducah,.. Kentucky, be, and he .is hereby, authorized, empowered and directed to institute. -and prosecute, . pursuant to KRS 94.360, contingent upon the granting -of an .easement as is satis-. factory with the City Engineer fora storm sewer, an action. in the McCracken Circuit Court for a judgment ordering: the closing of -the alley, described in Section 1- above. SECTION 3. This ordinance shall be in full force and effect; from and - after the date of its adoption.
