ORDINANCE NO. 83-10-2434
AN ORDINANCE, AUTHORIZING THE CITY TREASURER TO ESTABLISH AN ESCROW
ACCOUNT TO BE:ESCROWED ON. BEHALF OF THE COMMONWEALTH OF KENTUCKY, NATURAL RE-
SOURCES AND ENVIRONMENT PROTECTION CABINET
WHEREAS, on July 12 1983, the City of Paducah authorized the Mayor to
enter into an AgreedLOrder-.with the Commonwealth of Kentucky, Natural Resources
and Environment =Protection ;Cabinet, regarding the operation and closing of the
landfill, and
WHEREAS, said Agreed Order, Section -10-A, requires the City to place in
an escrow account, the sum of $35,000 to be escrowed on behalf of the Natural
Resources and, :Environment Protection Cabinet upon the City's failure to perform
the terms of sairk- Agr6ed�Order-.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
- ` SECTION --1-. - -That the -City Treasurer be authorized to establish an escrow
account, in Citizens=Bank & Trust Company, Paducah, Kentucky, the sum of $35,000.
SECTION ;2;: Said ,escrow account shall be held for a period of two (2)
years after the closure, -of, -the landfill or until notification from Natural Re-
sources and Environment Cabinet that all terms of said Agreed Order have been
complied with, whichever is -sooner.
SECTION 3. This.ordinance shall be read on two separate days and will
be effective upon.publication of title and a certified summary thereof.
