HomeMy WebLinkAbout04/02/0237 APRIL 2, 2002 At a Meeting of the Board of Commissioners, held in the Commission Chambers at City Hall at 5:00 p.m., Tuesday, April 2, 2002, Mayor Paxton presided, and upon call of the roll by the Assistant City Clerk, the following answered to their names: Commissioners Abraham, Coleman, Montgomery, and Mayor Paxton (4). Commissioner Smith was late M. PROCLAMATION DR. MARTIN LUTHER KING, JR'S CONTRIBUTION TO SOLID WASTE zl� INDUSTRY DAY MOTIONS SUSPEND ORDER OF BUSINESS Commissioner Abraham offered motion, seconded by Commissioner Montgomery, that the rules for conducting City Commission Meetings be suspended insofar as they are in conflict with the printed agenda for this meeting; otherwise, the rules are to remain in full force and effect. Adopted on call of the roll, yeas, Commissioners, Abraham, Coleman, Montgomery, and Mayor Paxton (4). PUBLIC DISCUSSIONS J. W. Cleary, President of NAACP, spoke in regards to hiring policies within the Police Department. Commissioner Smith arrived at this time. Charles Hamilton, citizen, raised the concern as to how former police officer Charles Farris was terminated. He asked that Mr. Farris be reinstated. He also said deep concern about our community and our police department. Arthur Lee, father of Hosea Lee (autistic man who was stopped by police officer in alley behind his house) said that he had a meeting with Chief of Police, Mayor and City Manager today about why Hosea was stopped. He was not pleased with the answer he was given. He feels that the ratio of minority police officers hired in the Police Department is not balanced with the amount of white officers and that the police officers need more training in dealing with people with mental illness. Rev. Henderson doesn't like to make every issue a black/white issue. He was here to discuss why Alvin Hodge has not been hired. He requested that if there is something detrimental in his file to please make Mr. Hodge aware of it or if there is not anything to please hire him. Gladman Humbles is not satisfied with how our local government is run. L�-- Rev. Harvey made comments about trying to deal with the Commission and not getting v results. J. W. Cleary, also here about Police Officer Phillip Crider. He is now not physically able to carry out his duties as a patrolman. They would like for the newly created Administrative Officer position to be made 100% administrative and for Mr. Crider to be placed in this position. Jonathan Hines, area director for the NAACP and also am a Kentucky Tourism Ambassador, one of the issues he is concerned about is the police officers and how they handle themselves and citizens. Another issue things going backwards in this country. He said there is a petition being circulated around the City for permission to disallow Bob Noble Park as a site for the Civil War Re-enactment because it is violating several city ordinances. Annie Conner, citizen, spoke about Paducah Police Department. Was here on behalf of her son being arrested on October 22, 2002. Her main concern is with one of the U detectives with the Paducah Police Department and how he is handling the investigation. Says the Crimestopper Program needs help. 38 APRIL. 2, 2002 Michael Burns, citizen, problems that people feel are in Police Department should not be ti a concern by just the African-American race but by all people. Not just minorities. Human indignity should be a concern by everyone. Gladys Thomas, citizen, her sister is missing and feels she has not had any assistance from the Paducah Police Department in trying to locate her. V Joyce Henderson, spoke about embarrassing publicity she suffered because of newspaper article. WORKSHOP CITY CLERK POSITION CIVIL OR NON -CIVIL Commissioner Smith offered motion, seconded by Mayor Paxton, to remove the City Clerk's job from civil service to non -civil service. Lost on call of the roll, nays, Commissioners Abraham, Coleman, Montgomery and Mayor Paxton (4). Commissioner Smith voted yea (1). ADMINISTRATIVE OFFICER POSITION IN POLICE DEPT. Commissioner Abraham offered motion, seconded by Commissioner Coleman, that this administrative officer position be made 100% administrative and Officer Crider be placed in the position at his current sworn officer's pay. Adopted on call of the roll, yeas, Commissioners Abraham, Coleman, Montgomery (3). Nays, Commissioners Smith and Mayor Paxton (2). MUNICIPAL ORDERS PERSONNEL CHANGES: Commissioner Abraham offered motion, seconded by Commissioner Smith, that upon the recommendation of the City Manager, the Board of Commissioners of the City of Paducah orders that the personnel changes on the attached list be approved. (4 CANDIDATES) Commissioner Abraham offered motion, seconded by Commissioner Smith, that the Board of Commissioners of the City of Paducah order that the personnel changes listed below be approved. (Alvin Hodge) Lost on call of the roll, yeas, Commissioners Abraham and Coleman, (2) nays, Commissioner Smith and Mayor Paxton (2), abstain, Commissioner Montgomery M. Motion read again: Commissioner Abraham offered motion, seconded by Commissioner Smith, that upon the recommendation of the City Manager, the Board of Commissioners of the City of Paducah orders that the personnel changes on the attached list be approved. (4 CANDIDATES) Commissioner Coleman offered motion, seconded by Commissioner Montgomery, that the above motion for personnel changes for the four police candidates be tabled until the Police Chief has the opportunity to thoroughly investigate. Adopted on call of the roll, yeas, Commissioners Abraham, Coleman and Montgomery (3). Nays, Commissioner Smith and Mayor Paxton (2). Commissioner Smith offered motion, seconded by Commissioner Montgomery, that Jason Clark and Justin Canup be hired as police officers. (SEE MUNICIPAL ORDER BOOK) Adopted on call of the roll, yeas, Commissioner Montgomery, Commissioner Smith and Mayor Paxton (3). Abstain, Commissioner Abraham (1). Nay, Commissioner Coleman M. ORDINANCES — INTRODUCTION ORDINANCE PROVIDING FOR THE REGULATION OF GENERAL ASSEMBLIES Commissioner Coleman offered motion, seconded by Commissioner Montgomery, that the Board of Commissioner introduce an ordinance entitled, "AN ORDINANCE PROVIDING FOR THE REGULATION OF GENERAL ASSEMBLIES". This 39 APRIL 2, 2002 ordinance is summarized as follows: An ordinance providing for the regulation of general assemblies, establishing guidelines for the regulation thereof, and establishing penalties for the violation of the provisions of this ordinance. Note: The above summary introduced two ordinances. One with changes and one without changes from what was sent to Commissioners in packet. Commissioner Montgomery offered motion, seconded by Commissioner Smith, that The Board of Commissioners introduce the ordinance that did not include the following: "SECTION 6. (7) A schedule setting forth a general description of each activity 1/ conducted as a part of the general assembly, the number of participants for each activity, GL the criteria, requirements, and qualifications utilized in determining each of the participants, and the fees to paid by each participant. Once filed, this schedule may not be amended without prior City Commission approval. (8) A statement that the determination of authorized participants shall be made on a "first come, first served" basis. SECTION 18. (3) Notwithstanding the provisions of Sections 6 and 7 above and as an exception thereto, as to any permitted general assembly which shall take place during the Quilt Show, Summerfest or the Barbeque Festival, and which general assembly is conducted in close proximity of such event, such general assembly shall be subject to the discretion and instruction of the event coordinator of the Quilters Show, Summerfest, Barbeque Festival, as the case may be." Adopted on call of the roll, yeas, Commissioners Montgomery, Smith and Mayor Paxton (3). Nays, Commissioners Abraham and Coleman (2). ORDINANCE RELATING TO A BUSINESS LICENSE FOR PARADES AND GENERAL ASSEMBLIES Commissioner Montgomery offered motion, seconded by Commissioner Coleman, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE RELATING TO A BUSINESS LICENSE FOR PARADES AND GENERAL ASSEMBLIES". This ordinance is summarized as follows: "SECTION 1. A new subsection shall be added under the term `gross receipts' under Section 106-61 to include the following: "(8) The term `gross receipts' shall not include the gross receipts from sales made by a participant in an event relating to a parade or general assembly for which a permit was issued". SECTION 2. A NEW SECTION. A new section shall be added under Section 106, Division II, Tax Schedules, of the Paducah Code of Ordinances as follows: "Parades and General Assemblies: Any person organizing or sponsoring a parade or general assembly under a permit issued from the City Hall pay a license fee of Three Hundred Dollars ($300.00) for each permitted event during any calendar year. If such person secures a business license under this Section, it will not be necessary for any person participating in any activity in the permitted area of the event to secure a separate business license for such activity unless otherwise provided by ordinance."
