ORDINANCE NO. 82-2-2212
AN ORDINANCE AMENDING SECTION 19-7, SUNDAY SALES AND OPERATIONS, OF THE
CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That Section 19-7, Sunday Sales and Operations of the Code of
Ordinances be, and it is hereby,_ amended to read as follows:
(a) Amusementmachines, pool _tables, etc—allowed. _It shall be lawful for
any person to hold out for public use and operation coin-operated amusement machines,
pool tables of any type and billiard tables of any type on Sundays. Coin-operated
amusement machines shall be defined to include coin-operated pin ball machines, video
playing machines, air hockey machines, billiard tables of any type, pool tables of
any type, football machines and other coin-operated amusement machines of a like
nature.
(b) Retail sales. It shall be lawful for any person to conduct retail
sales on Sunday.
(b c) Restriction on Sunday morning operation. Notwithstanding such
authorization, no coin-operated amusement machine or billiard table or pool table
shall be held out for public use nor shall any retail sales take place on Sunday
between the hours of 6:00 o'clock a.m. and 12:00 o'clock noon.
(e d) Alcoholic beverages. Notwithstanding the above authorization, no
business shall be authorized to operate on Sunday which has been granted a license
for sale at retail of alcoholic liquor or beverages.
(d e) General regulations. Notwithstanding subsection (a), (b), (c) and
(e) (d) of this section, all Sunday activities allowed by this section shall be
subject to the following limitations:
(1) No employer shall require, as a condition of
employment, that any employee work on Sunday or on any
other day of the week which any such employee may
conscientiously wish to observe as a religious sabbath.
(2) No employer shall in any way discriminate in the hiring
or retaining of employees between those who designate a
sabbath as their day of rest and those who do not make
such designation, provided, however, that the payment
of premium or overtime wage rates for Sunday employment
shall not be deemed discriminatory. '
(3) Every employer engaged in Sunday activities shall allow
each person employed by him in connection with such
business or service, at least twenty-four (24)
consecutive hours of rest in each calendar week in
addition to the regular periods of rest normally
allowed or legally required in each working day.
(4) Every business authorized by subsections (a) and (b) of
this section shall not allow intoxicated persons on
said premises nor allow any person to possess alcoholic
beverages on the premises.

(5) Every business allowed by subsection (a) and (b) of
this section shall have a person in charge on the
_.premises during all hours which said business is
operating on Sunday, and said person shall be at least
eighteen (18) years of age.
(6) No business shall be required to be open on Sunday as a
part of a lease agreement, franchise agreement or any
other contractual agreement. The provisions of this
sub -section shall not apply to any lease agreement,
franchise agreement or any other contractual
arrangement entered into before July 15, 1980.
(f) Notwithstanding sections (a) , (b) (c) (d) and (e) of this ordinance,
any business authorized by KRS 436.160 shall not be prohibited from conducting
business on Sunday.
(e g) Penalty. Violation of any subsection of this section shall be
deemed to be a Class B misdemeanor, and shall be punishable by a fine not to exceed
two hundred fifty dollars ($250.00) or confinement in the county jail for a term not
to exceed ninety (90) days.
SECTION 2. This ordinance shall be read on two separate days and will be
effective upon publication in full.
