HomeMy WebLinkAbout82-2-2203273 ORDINANCE NO. 82-2-2203 AN ORDINANCE ESTABLISHING THE AMOUNT TO BE CHARGED FOR CONNECTING TO CITY SANITARY SEWERS CONSTRUCTED BY THE CITY KNOWN AS THE PERKINS CREEK SEWER LINE AND PROVIDING FOR THE ISSUANCE OF CONNECTION PERMITS, PROVIDING FOR THE PAYMENT OF THE CONNECTION CHARGES, AND PROVIDING PENALTIES FOR VIOLATION OF THE PROVISIONS HEREOF NOW, THEREFORE, BE IT ORDAINED.BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The charge for connection to the Perkins Creek Sanitary Sewer constructed by the City of Paducah, more particularly described as follows: A portion of the Perkins Creek Sanitary Sewer System and tributary systems described as follows: Beginning at the lift station on the south side of the Cairo Road (KY 305) located between the floodwall and Perkins Creek; thence running generally with Perkins Creek in a southwesterly direction to a point near the intersection of Coleman Road with the Hinkleville Road (US 60); thence following the Hinkleville Road (US 60) to a point on the west side of I-24 where Frontage Road 02 intersects; thence with Frontage Road #2 to its south terminus. TRIBUTARY #1. Also_, a tributary line to the above described system which begins near the northwest corner of Stuart Nelson Park and continues along the abandoned railroad fill to Coleman Road. TRIBUTARY #2. Also, a tributary line to the above described system which begins at Frontage Road #2 on the south side of Hinkleville Road (US 60) and runs in a westerly -direction along the south side of Hinkleville Road to Holt Road. TRIBUTARY #3. Also, a tributary line to the above described system which begins just west of I-24 and north of Hinkleville Road (US 60) and encircles the Kentucky Oaks Mall site. A. Connection Charges. (1) The charge for connecting a single family residence or a church to the Perkins Creek Sanitary Sewer is established at $1,500.00. A separate fee shall be paid for each establishment regardless of whether the connection to the sewer system is by individual service line or shared service line. (2) The charge for connecting a commercial establishment is established at $2,500.00. A separate fee shall be paid for each establishment regardless of whether the connection to the sewer system is by individual service line or shared service line. (3) The charge for connection of a multi -family residence or main (a main is a sewer line 8 -inches or larger serving several pieces of property which is dedicated and accepted by the City of Paducah) is: a. $2,500.00 AND b. $200.00 per residential unit connected to the main plus $350.00 for each commercial unit connected to said main. The unit charge is to be paid as each unit is connected to the main. 274 B. Kentucky Oaks Mall. In recognition of a contract entered into between the City and the Cafaro Company on September 22, 1981, and considerations of moneys paid under said contract to the City, the Cafaro Company, and other users situated on the Kentucky Oaks Mall site that have an agreement as of September 22, 1981 with Cafaro, its successors or assigns, obligating the Cafaro Company, its successors and assigns, to pay any tap -on fees are hereby considered as having paid all tap -on fees assessed by this ordinance. However, all development at the Kentucky Oaks Mall site not specifically exempted by this paragraph shall pay a tap -on fee as computed in this ordinance. C. Service Lines. All costs for service lines including but not limited to boring or trenching (whether on or off of the right of way or easement) shall be paid for by the person connecting to the sewer system. SECTION 2. No connection to said sanitary sewer system shall be made by any property owner or other person, firm or corporation, except under permit for such connections issued by the Building Inspector of the City. SECTION 3. The Building Inspector shall not issue a connection permit set out in Section 2 hereof until he has received evidence that the proper connection fee has been paid to the City Treasurer. SECTION 4. It shall be unlawful for any person, firm or corporation to fail to make the connection required by Section 32-4 of the Code of Ordinances of the City of Paducah to the sanitary sewer construction in the above-described territory. SECTION 5. Section 32-5 of the Code of Ordinances shall not be applicable to the Perkins Creek Sewer System. SECTION 6. All ordinances or part of ordinances in conflict herewith, are to the extent of such conflict, hereby repealed. SECTION 7. This ordinance shall be read on two separate days and will be effective upon publication in full. John K.
