HomeMy WebLinkAbout81-11-2169199 ORDINANCE NO. 81-11-2169 AN ORDINANCE APPROVING THE AMENDMENT OF THE FRANCHISE AGREEMENT BETWEEN THE CITY OF PADUCAH AND COMCAST CABLE OF PADUCAH, INC. WHEREAS, the City and Comcast Cable of Paducah, Inc., entered into a Franchise Agreement on April 4, 1975, and WHEREAS, it is the mutual desire of the City and Comcast to now amend said Franchise Agreement. NOW,"THEREFORE,-BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: -SECTION 1. That an amendment to the Franchise Agreement between the City and Comcast Cable of Paducah, Inc. be enteredinto, said amendment to the Franchise Agreement shall contain the following terms and conditions: 1. That Comcast Cable of Paducah will provide programming as set forth in Exhibit A,, attached hereto, which basically includes the proposal of the Cable Authority at its October 1, 1981, Public Hearing., 2. Comcast will upgrade the technical aspects of, the system to provide 35 -channel capability. 3. Comcast will agree to negotiate with any responsible third party the cost and necessity of two-way capability if needed to provide services such as burglar, fire, medical alarms, etc. 4. The base rate for the 22 "non -pay" programs outlined in Exhibit A shall be $7.95 per month. (a) The fee for each additional outlet at a location shall be increased from $1.50 to $2.00 per month. (b) Comcast shall provide any subscriber who desires to purchase a converter box that box at the prevailing retail price. Comcast shall reserve the right to charge an optional maintenance contract for the con- verter or issue a disclaimer therefor. (c) Comcast will lease to any person a converter box at a cost of $1.50 per month per box. Comcast has the right to request a rate increase in the converter lease charge anytime it can show that the actual cost of leasing the converter boxes exceeds $1.50 per month. 5. Comcast shall pay to Channel 2 of Paducah Community College the sum of Twenty Thousand Dollars ($20,000.00) per year to operate the public access channel, provided that Channel 2 continues with its present programming quality and level. SECTION 2. That the Corporation Counsel shall approve all amendments to said amendments to the Franchise Agreement. SECTION 3. This ordinance shall be read on two separate days and will be effective upon publication of title and a certified summary thereof.
