HomeMy WebLinkAbout81-10-2149177 ORDINANCE NO. 81-10-2149 AN ORDINANCE AUTHORIZING THE CITY OF PADUCAH TO JOIN THE PURCHASE AREA DISTRICT HEALTH DEPARTMENT, AUTHORIZING THE PADUCAH-McCRACKEN COUNTY HEALTH DEPARTMENT TO TRANSFER ITS ASSETS TO THE PURCHASE AREA DISTRICT HEALTH DEPARTMENT, AND APPROVING THE USE OF FACILITIES OWNED BY THE CITY OF PADUCAH BY THE PURCHASE AREA DISTRICT HEALTH DEPARTMENT WHEREAS, KRS 212.810 through 212.930 authorizes the counties in a district to form a District Health Department; and WHEREAS, KRS 212.910 authorizes the City by joint action with McCracken County to join the District Health Department; and WHEREAS, the Department of Human Resources for the Commonwealth of Kentucky has requested that the Purchase Area form a District Health Department; and WHEREAS, the Board of Commissioners of the City of Paducah find that it would be to the benefit of the Purchase District to form a District Health Department and for the City to participate in that Department; and WHEREAS, the Fiscal Court of McCracken County has stated that in its opinion it would be in the best interest of McCracken County to join the Purchase Area Health Department. NOW, THEREFORE, be it ordained by the City of Paducah as follows: SECTION 1. That the City of Paducah, subject to joint action of McCracken County, Kentucky, hereby joins with the Purchase Area District Health Department in accordance with provisions of KRS 212.810 to 212.930. SECTION 2. The Mayor is hereby authorized to execute any and all documents necessary to accomplish the purposes set forth in Section 1 hereof. SECTION 3. The Mayor is hereby authorized to enter into an agreement with the Fiscal Court of McCracken County to provide for the payment of cost of creating, maintaining and operating the District Health Department, said agreement to provide that all monetary appropriations shall be paid from the annual tax levy made by McCracken County, Kentucky, for that purpose. SECTION 4. The City of Paducah hereby authorizes the Paducah -McCracken County Health Department to transfer its assets to the Purchase Area Health Department, and the City of Paducah authorizes the Purchase Area Health Department to 178 use any real estate owned by the City of Paducah which is presently being used by the Paducah -McCracken County Health Department. SECTION 5. This ordinance shall become effective only upon the creation of the Purchase Area Health Department under provisions of KRS 212.810 through 212.930. ,- If said Health Department is not formed within two (2) years from the date of this ordinance, or if McCracken County does not adopt a similar ordinance or resolution or does not approve the contract between the City of Paducah and McCracken County, this ordinance shall become null and void.
