ORDINANCE NO. 81-9-2147
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT PROVIDING FOR
THE CAFARO COMPANY TO PAY $60,000.00 AS A SEWER TAP -ON FEE FOR THE KENTUCKY OAKS MALL
AND PROVIDING FOR TEMPORARY SERVICE IF PERKINS CREEK SANITARY SEWER SYSTEM IS NOT
COMPLETED PRIOR TO THE COMPLETION OF THE MALL, AND SUPERSEDING THE AGREEMENT
PREVIOUSLY ENTERED INTO BETWEEN THE CITY AND THE CAFARO COMPANY AND APPROVED BY
ORDINANCE NO. 81-3-2060
WHEREAS, the Cafaro Company is in the process of constructing a regional
mall at the intersection of U.S. 60 and I-24 within the City of Paducah, Kentucky,
and
WHEREAS, sanitary sewers are needed to properly construct and manage a
regional mall, and
mall, and
WHEREAS, sanitary sewers are not presently located adjacent to the regional
WHEREAS, the City of Paducah is planning in the future to constrcut a
sanitary sewer known as the Perkins Creek Project which will run adjacent to the
I-24/U.S. 60 site, and
WHEREAS, IT IS THE DESIRE OF THE Board of Commissioners of the City of
Paducah and the Cafaro Company to reach an agreement as to sanitary sewer facilities
for the regional mall.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Mayor is hereby authorized to enter into an Agreement with
the Cafaro Company, which Agreement is attached hereto and made a part hereof as if
set out in full.
SECTION 2. This ordinance shall be read on two separate days and will be
effective upon publication of title and a certified summary thereof.
