HomeMy WebLinkAbout81-9-2146169 ORDINANCE NO. 81-9-2146 AN ORDINANCE AMENDING .ARTICLE III, ELECTRICAL CONTRACTOR AND ELECTRICIAN EXAMINING BOARD BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY SECTION 1. That Section 7-40 be, and it is hereby, amended and re - ordained so that said section shall hereafter read as follows: "Sec. 7-40. Establishment. There is hereby created an Electrical Inspection Appeals and Electrical Con- tractors' and Electricians' Examining Board of the City of Paducah, Kentucky". SECTION 2. That Section 7-40.1 be, and it is hereby, amended and re - ordained so that said section shall hereafter read as follows: "Sec. 7-40.1. Purpose; authority. The purpose of said board is to hear appeals from the Inspection Depart- ment as to the proper application of the electrical code of the City of Paducah and to administer KRS 227.450 through 227.500 and issue and revoke electrical con- tractor's and electricians' licenses, conduct and make regulations for conducting examinations of applicants, and govern the method and time of making applications for examination and a time within which the applicant shall be examined after application has been filed. The board may adopt any other reasonable regulations to administer KRS 227.450 through 227.500. The board is further.. empowered to set a reasonable fee before issuing of a license to electrical contractors and electricians" . SECTION 3. That Section 7-40.6 be, and it is hereby, amended and re - ordained so that said section shall hereafter read as follows: "Sec. 7-40.6. Certain officials and employees ineligible to serve; con- flict of interest. No employee of the Inspection Department .of the City of Paducah shall be appointed to the board. No member of the Board shall hear an appeal in a case in which he has a financial interest". SECTION 4. That a new Section 7-40.9 be created to read as follows: "Sec. 7-40.9. Upon receipt of a written appeal from the party aggrieved by an electrical inspector of the City of Paducah, the Board shall . convene a hearing to consider the appeal within fifteen (15) days". i 170 SECTION 5. That a new Section 7-40.10 be created to read as follows: "Sec. 7-40.10. All parties to the appeal shall be notified of the time and place of the hearing, by letter mailed by certified mail no later than ten (10) days prior to the date of the hearing". SECTION 6. That a new Section 7-40.11 be created to read as follows: "Sec. 7-40.11. The Board shall render a decision within five (5) working days after the hearing. The Board may uphold, amend or reverse the decision of the electrical inspector". SECTION 7. That Article IV, Electrical Inspection Appeals Board, Sections 7-45.1, Establishment; 7-45.2, Purpose; 7-45.3, Composition; 7-45.4, Vacancies; 7-45.5, Compensation; 7-45.6, Conflict of Interest; 7-45.7, Quorum; 7-45.8, Con- vening of hearing; 7-45.9, Notification of hearing; and 7-45.10, Time limit on decision; appeal from board limited, be, and they are hereby, repealed and deleted in their entirety. SECTION 8.
