HomeMy WebLinkAbout81-4-2085e ORDINANCE NO. 81-4-2085 AN ORDINANCE ACCEPTING THE PROPOSAL' OF JAKE BROWN AND ASSOCIATES AS :AUCTIONEER FOR THE-. -PUBLIC AUCTION OF CERTAIN REAL ESTATE AND PERSONAL PROPERTY OWNED BY -THE CITY OF PADUCAH . - WHEREAS-, the City of Paducah owns certain real estate consisting of City lots which are excess real- estate and -of no' value to the`" City for Governmental purposes-,--and,- WHEREAS-1 .,- urposes; •and WHEREAS-;.:- the -City of Paducah• -owns --various motor vehicles, furniture, and other items of personal property which are excess property and do not have value to the City in the future, and.. WHEREAS, Kentucky Revised Statutes allow the City to dispose of excess real estate and personal property by means of a public auction, and WHEREAS, Jake Brown and Associates has submitted a proposal to the City for auctioning certain City property; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The Mayor is hereby authorized to enter into an agreement with Jake Brown and Associates to act as auctioneer for the City of Paducah on the following described property: A. Real estate lots within the City of Paducah, more particularly described by their street .address as follows: 428 South 7th Street; 605 South 7th Street; 1151, 1155, 1159 North 11th Street; 632 Husbands Road; 1356, 1358, 1314 South 9th Street; northwest corner of Shelby and Ficklin; west side of Shelby 100 feet from Ficklin; and lots number 10 through 13 on the east side of Owens Street. All lots to be more particularly described by the records of the City Engineer. The Mayor is further authorized to enter into a contract with Jake Brown and Associates for the sale of certain personal property consisting of motor vehicles, furniture and other personal property to be specifically identified by the City Manager. SECTION 2. All property is to be sold as is and where is for cash to the highest bidder with no warranties as to merchantability, fitness or title to be given. All real estate is to be sold by Quitclaim Deed for cash to the highest bidder. The City reserves the right to reject any and all bids received on real estate, and all sales of real estate are subject to confirmation by the Board of Commissioners within thirty (30) days from the date of the auction. 70 SECTION 3. The City Treasurer is hereby authorized to pay Jake Brown and Associates for a fee for their services to be -computed as follows: 7A.- - A -'maximum of $4.,-500 for advertising -and preparation to be billed'to the City of Paducah ­byJake-Brown-and- Associates at 'their actual costs, plus ..B - i,-- 'Ten- (10%) of the gross-- sales price'of all personal property, and C.- '-Seven --(-7%) percent -:_of- the gross- sales price of all reale estate. - SECTION 4.
