HomeMy WebLinkAbout81-3-206631 ORDINANCE NO. 81-3-2066 AN ORDINANCE AMENDING CHAPTER 8, CEMETERIES, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY BE IT ORDAINED BY THE CITY OF, PADUCAH, KENTUCKY: SECTION 1. That Section 8-38'. Price of Grave lots, -sold under. the single grave privilege-, be amended- and reordained so that 'said section as amended and reordained-shall hereafter - read - as follows: "All grave lots sold in -Oak Grove -Cemetery and additions thereto, including Rushing Addition, under what is known as the single -grave privilege, the price thereof" -is Hereby fixed at a minimum of 'one hundred fifty dollars ($150.00) {one-•h=Tdreper' -grave, with certain exceptions re - qui -ring higher and lower prices as follows: (a) In the `West •Kentacky Mausoleum -(-Addition Building: Crypts- (top tier) ' . ` $10300.00 Crypts- (second row from top) 1, 400.-00' Crypts (bottom 3 rows) 1,500.00 -Alcoves (5 crypts)• ` 10, 000.00 Tombs (10 crypts)f 15, 000.00 (b)'- In 'the: Mausoleum Addition: Price per grave shall be - 300.00 (c) . In Rushing Addition: 1. In the first row facing Rushing Street in Section 6 200.00 2. In the second row of Section 6 behind the foregoing lots facing Rushing Street 175.00 (d) In Old Addition: All lots in Sections - 6, 7, '18 19 and `'2'9 din-Oalr£rrove-E��, the price per grave shall be 175.00 (e) For the small size grave lots in certain1'sections for the burial of children 12 years of age and under, the price per grave shall be 100.00 (f) All the above grave prices include perpetual care.-" SECTION 2. That Section 8-84; Refund of grave purchase price when body removed, be amended" and reordained so that said section as -amended and reordained shall hereafter read as follows: "Sec. 8-34. Refund of grave purchase price when body removed. 32 When a body interred in the cemetery under the single grave privilege is removed from such grave privilege, -and- the purchaser thereof tenders the ground back to the city, the -ci-ty-shall refund the original purchase price. thereof, -- {}ess-thy-pri-ce--of-the-headstene3,-to such purchaser, or his lawful representative." SECTION 3. That Section ,87-35, Limitations on; resale or transfer of lots; lot owner not .to -b.e compensated for: -burials:, :be amended and reordained so that' - said section as amended and reordained -shall hereafter -read -as follows: - !'Sec. 8-35. Limitations, on--resale-or transfer 'of lots; lot owner not to be compensated -for ....burials. .No -(pur-chase}.-person shall purchase, have, Bold; or- own any -lot or part of .a. lot -in .the. -cemetery for -the -purpose-of-resale speculation;-= or-- sale of single burial places, or sell, or transfer any lot, or part of a -lot in the cemetery'; unless such transfer -is first -authorized by the board of commissioners, "and such transfer- shall be made on the cemetery record by the -city clerk. - No person shall bury or-, suffer or permit any person to be buried -on any lot or part of a lot in the -cemetery owned or held by him, for a valuable consideration: Any person violating any provision of this section shall be fined, -not -less than ten dollars ($10.00) nor more than fifty dollars ($50.00) for each offense." -- SECTION 4. The charges for use of the receiving vault pending burial for the first month, or part thereof 30.00 For any period of time in excess of the first month, per month, or any part thereof. 20.00 ADDITIONAL SERVICES Sortdin- -grave-or-grave-lot-,--at�thanreplazing-avail- able-sad-following-grave-opening------��-90-- Setting government markers 20.00 Plac=fg-or-erecting--fou rdahons-for-grave-slabs------3� : 99 - All foundations for monuments (mrniumen-t-fonntdations) will be poured by the cemetery department at a per square foot cost of 10.00 All additional services such as the planting, relocating or removing of trees or shrubs, the construction or removal of curbs, and such services shall be at actual cost or designated rates to be prescribed and determined by the cemetery department superintendent. MISCELLANEOUSWORK ORDERS & INTERMENT WORK ORDERS The owner of any lot, a member of the owner's immediate family or his next of kin or the funeral director must sign an order for any work required to be performed on such lot and in the case of grave openings the order must contain a description or diagram locating the place on the lot for the opening. The person executing the aforesaid work order must also deposit with the superintendent of Oak Grove Cemetery the sum of one hundred dollars ($100.00) to insure the placement of a marker or monument at the grave site. The deposit shall be fully refundable if a marker or monument is erected within ninety (90) days after burial. In the event the monument or marker has not been erected within ninety (90) days after burial, the superintendent of the Oak Grove Cemetery shall cause to be erected a permanent type marker or monument to be paid for out of the aforesaid deposit. Any sum not actually expended shall be refunded to the party executing the work order. 34 SECTION "5. That Sections 8-16 through 8-21 (Article II) and Sections 8-39, 8-40 and 8-41 be, and they are hereby, repealed in their entirety. SECTION 6. This ordinance shall be read. on` two separate days and will be effective upon publication in full.
