HomeMy WebLinkAbout81-3-206023 ORDINANCE NO. 81-3-2060 AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT BETWEEN THE CITY OF PADUCAH AND THE CAFARO COMPANY, PROVIDING FOR THE CONSTRUCTION OF A FORCE MAIN SANITARY SEWER FROM THE CAFARO PROPERTY AT I-24 AND U.S. 60 TO AN EXISTING SANITARY SEWER ON COLE- MAN ROAD WHEREAS, the Cafaro Company is in the process of constructing a regional mall at the intersection of U.S. 60 and I-24 within the City of Paducah, Kentucky, and WHEREAS, sanitary sewers are needed to properly construct and manage a regional mall, and WHEREAS, sanitary sewers are not presently located adjacent to the regional mall territory, and WHEREAS, the City of Paducah is planning in the future to construct a sanitary sewer known as -the" Perkins Creek Project which will run' adjacent to the I-24/U.S. 60 site, and WHEREAS, it is the desire of the Board of Commissioners of the City of Paducah and the Cafaro Company to reach an agreement as to sanitary sewer facilities for the regional mall. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION "1. That the Mayor is hereby authorized to enter into a contract with the Cafaro Company, which contract is to be approved by the Corporation Counsel as to form and content. Said contract is to contain the following terms and conditions in addition to other terms and conditions deemed necessary by the Corporation Counsel: (a) The Cafaro Company shall construct at his own cost, a force main from the Mall site adjacent to U. S. 60 to the existing sewer main at the intersection of Coleman Road and Allen Lane. (b) The City of Paducah will purchase and install a lift station adjacent to the Mall site at U.S. 60 and I-24, at a cost not to exceed $50,000. (c) In the event the cost of the lift station should exceed $50,000, the Cafaro Company may reimburse the City of Paducah for all sums over $50,000. (d) The Cafaro Company will provide necessary engineering including specifications for the lift station. (e) The force main sanitary sewer system shall become the property of the City of Paducah upon completion of construction. 24 (f) Upon completion in the future of the Perkins Creek Sanitary Sewer System, the Cafaro Company and/or its successors agree to deposit all sanitary sewage into that system, without paying the City a tap - on fee, and abandon the forced main -being constructed, at which time the City may remove any and all portions of the lift station and force main as the City deems appropriate. (g) The City will allow the Cafaro Company to use its existing right-of-way for construction of the force main. SECTION 2. The City Manager is hereby authorized to advertise for bids for the construction of the lift station identified in Section 1 hereof, upon receipt of the specifications from the Cafaro Company. SECTION 3. This ordinance shall be read on two separate days and will be effective upon publication of title and a certified summary thereof.
