ORDINANCE NO. 84-10-2605
AN ORDINANCE APPROVING THE PAYMENT OF A JUDGMENT TO PAUL MOORE
WHEREAS, on May 53, 1981, Paul Moore was transferred as Chief -Inspector of the
Inspection Department to the position of -Chief Inspector of.the Safety Department; and
WHEREAS, Mr. -Moore filed suit in the McCracken Circuit Court,: Civil Action No.
81 -CI -391, requesting reinstatement to his former position; and
WHEREAS, on May 17, 1983, Mr. Moore was -laid -off from his.position as Chief
Inspector in the Safety Department; and
WHEREAS, Mr. Moore filed suit in McCracken Circuit Court in Civil Action 83 -CI -484,
requesting pay for the time in which he was laid off; and
WHEREAS, McCracken Circuit Court decided that Mr. Moore was improperly transferred
from the Inspection Department to the Safety Department, which.decision.was confirmed by the
Court of Appeals of the State of Kentucky; and
WHEREAS, the McCracken Circuit Court entere& judgment in favor of Mr. Moore for all
sums which he lost as a result of the actions of the City of Paducah, including the. -
difference in pay between the Chief Inspector of the Inspection Department and:the Safety
Department, lost wages during the period he was laid off between May 16, 1983, and February
1, 1984, and pension amounts the City would have paid for pension payments, social security
payments, vacation leave, life insurance, and longevity pay, and including travel expenses
Mr. Moore incurred to maintain his state certifications as a Certified Electrical and
Building Inspector; and
WHEREAS, the City has computed the amounts due Mr. Moore to be $25,781.47, plus
interest in the amount of $3,840.95, for a total of $29,622.42.
BE IT ORDAINED BY THE CITY OF PADUCAH AS FOLLOWS:
SECTION 1. That the City Treasurer is authorized to issue a check to Paul Moore
and James Owens Chartered, his attorneys, in the amount of $29,622.42 in payment of the
Judgment of the McCracken Circuit Court in Civil Action No. 83 -CI -484 and Civil Action No.
81 -CI -391.
SECTION 2. Payment of these sums is to be charged to Account Number
10-500-150-494.
SECTION 3. In order to avoid additional accrual of interest in the amount of
$370.80 for the month of November, 1984, an emergency is hereby declared so that this
ordinance will become effective immediately upon passage -by the Board of Commissioners.
