HomeMy WebLinkAbout84-8-2564ORDINANCE-NO..84-8-2564 -AIS ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE SETTING OF BOND AMOUNT AND ACCEPTING THE DEDICATION OF THE PUBLIC LIGHTS -OF -WAY OF PROPERTY OWNED BY DRS. MYRE, MONTGOMERY, SHIELDS AND WHEELER AND LOCATED OFF JACKSON STREET WHEREAS, the Paducah Planning Commission, by motion dated August 6, 1984, recommended to the Board of Commissioners of the City of Paducah, Kentucky, the'adoption of an ordinance approving the final plat accepting the dedication of the public rights-of-way and easements -shown thereon, and WHEREAS, pursuant to Section '12(2) (b) the City Engineer has recommended a per formance bond in the amount of $100,000.00 to be posted by Drs Ayre, Montgomery, Shields and Wheeler for, construction of streets, storm drainage systems, sanitary sewers, water lines, monuments'; and other designated public improvements, NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a motion adopted by the Paducah Planning Commission on August 6, 1984, entitled "THE APPLICATION OF DRS. MYRE, MONTGOMERY, SHIELDS AND WHEELER FOR THE DEDICATION OF PARK PLAZA DRIVE AND CUL-DE-SAC TO THE CITY OF PADUCAH, KENTUCKY", be -approved as the final report of said Commission respecting the matters set forth";Ierein. SECTION 2. That the dedication of the public rights-of-way and public utility easements shown on said plat shall be, and they are hereby, accepted -but -such acceptance shall not constitute an undertaking on -the part of this Board or the City of Paducah, Kentucky, for the construction, improving or maintaining of said right-of-way, that being a matter for separate consideration and action. The Mayor is hereby authorized to subscribe a certificate of approval on the plat. SECTION 3. That pursuant to Section 12(2) (B) of the Paducah Subdivision Ordinance a performance bond in the amount of $100,000.00, with approved corporate surety, and running to the City of Paducah is set and that said bond shall be in such form and containing such contents that meet the approval of the City Engineer and the Corporation Counsel of the City of Paducah. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will be effective upon publication of title and a certified summary thereof.
