HomeMy WebLinkAbout84-7-2539108 ORDINANCE NO. 84-7-2539 AN ORDINANCE AMENDING SECTION FIVE, PARAGRAPHS FIVE AND SIX, OF SUBDIVISION REGULATIONS OF THE -CODE OF ORDINANCES OF THE CITY-OP-"MUCAH, KENTUCKY BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Raducah Planning Commission on June 18, 1984,.entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH x=T.EAkRING COMMISSION ON THE PROPOSED AMENDMENT OF SECTION 5, PARAGRAPHS 5 AND 6 OF THE PADUCAH SUBDIVISION ORDINANCE", be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That:Paragraph Five of Section 5, Required Improvements, of the Subdivision Regulations of the Code of Ordinances be amended and reordained so that said Section 5 shall hereafter read as follows: i "Sec. 5. Required Improvements. 5. SEWERS The subdivider shall provide the subdivision with a complete sanitary sewer system acceptable to,.the state and local health officials and to the commission. The city will reimburse the subdivider for the cost of the system by collections of sewer tap -on fees on the individual lots within the subdivision. Free and clear title to the system shall pass to the city upon the first tap -on reimbursement to the develop- ment. The balance is to be payed as each tap -on is made. Said balance to carry no interest. The cost of the system shall be established by the contract amount resulting from competitive bidding with payments verified by a licensed engineer. When a sanitary sewer lateral system is to be installed, the city may require sewers of a size larger than needed to service the area watershed. In such cases the subdivider shall cooperate with the city in the design of the sewer system, and the city shall be responsible for the immediate payment of the additional cost of installing the larger sewer. The plans and specifications for the installation of a sanitary sewer system shall be prepared by the subdivider and approved by the city engineer. The city engineer shall receive one set of the plans and specifications as approved, and the city shall inspect and approve the installation of the sanitary sewer system installation. The plans and specifications for such system as built shall be filed with the planning commission. Linen or mylar tracings shall be furnished to the city engineer. In the absence of an available sewer system, the subdivider may propose to construct a subsurface lateral field sewage disposal system. Minimum lot area requirements for single family dwelling units shall be one acre per unit. All multi -family dwelling units shall require at least one-half acre per unit. Commercial lateral disposal systems shall be in accordance with the' requirements established by the McCracken County Health Department. 6. WATER The- Wa�e�-Weeks-�e-ffie�e�9-tee-the-grass-p�e�. A complete water distribution system shall be provided by the subdivider, developer, or property owner in accordance with Paducah Water Works rules and regulations". SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the de- ficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs, and provisions. SECTION 5. This ordinance shall be read on two separate days and will be effective upon publication of title and a certified summary thereof.
