HomeMy WebLinkAbout84-5-250963 ORDINANCE NO. 84-5-2509 AN ORDINANCE AUTHORIZING WILLIAMS, HOUSMAN, SPARKS & FRANKLIN TO DEFEND JOE VITERISI, HAL COLE, HAROLD FORD, JAMES W. UTTER AND L. DANIEL KEY IN SUITS FILED BY GLADMAN C. HUMBLES WHEREAS, Gladman C. Humbles, an employee of the City of Paducah who was suspended on March 21, 1984, filed suit against the City of Paducah in McCracken Circuit Court and in the United States District Court for the Western District of Kentucky, and WHEREAS, said lawsuit is filed against the City of Paducah, Joe Viterisi, Hal Cole, Harold.Ford,. James W. Utter and L. Daniel Key, individually, as a result of their actions as members.. of the Board of Commissioners, as Corporation Counsel and as Assistant Corporation Counsel -of the City of Paducah, and WHEREAS, the Board of Commissioners of the City of Paducah finds that any actions taken by Joe Viterisi, Hal Cole, Harold Ford, James W. Utter and L. Daniel Key were in the best interest of the City of Paducah in furtherance of their official duties as members of the Board of Commissioners, as Corporation Counsel and Assistant Corporation Counsel of the City of Paducah. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah shall provide Joe Viterisi, Hal Cole, Harold Ford, James W. Utter and L. Daniel Key., individually, with legal representation and defenses in the suit filed by Glad -man C. Humbles against them individually in McCracken Circuit Court and in the United States District Court for the Western District of Kentucky. SECTION 2. That Williams, Housman, Sparks & Franklin be instructed to defend Joe Viterisi, Hal Cole, Harold Ford, James W. Utter and L. Daniel Key, individually, and the City of Paducah, Kentucky, in said suit. SECTION 3. That Williams, Housman, Sparks:-- `'Franklin shall be paid at the pre- vailing rate for attorneys, and said expense shall be charged to Account No. 10-500-150-427, Court Costs and Fees. SECTION 4. Due to the necessity of defending these actions, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its adoption with one reading.
