ORDINANCE NO. 84-2-2474
AN ORDINANCE AUTHORIZING THE SALE OF RIGHT OF WAY BY THE CITY OF PADUCAH, KENTUCKY,
TO THE COMMONWEALTH OF KENTUCKY FOR THE USE AND BENEFIT OF THE DEPARTMENT OF TRANSPORTATION IN
CONSTRUCTION OF THE OLD MAYFIELD ROAD PROJECT
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That for and in consideration of the sum of $7,000.00 the City of
Paducah, Kentucky, does hereby authorize the sale to the Commonwealth of Kentucky for the use
and benefit of the Department of Transportation, a parcel of land lying and being in McCracken
County, Kentucky, and more particularly described as follows:
PARCEL NO. 8.
Beginning at a point 65' left of Old Mayfield Road Station 14+83.31, being
315.62' in a southerly direction along the centerline from the intersection of
Old Mayfield Road and the centerline of the, Paducah and Illinois Railroad
tracks; thence along an arc to the right for 234.79' having a radius of
1,974.86'; the chord of which is N 40 2' 48" W for 234.64', to a point 65'
left of Station 17+10.37; thence S 310 0' 55" E for 206.22' crossing the Old
Mayfield Road centerline Station 15+93.28 to a point 30.84' right of Station
15+29.27; thence S 570 25' 00" W for 106.46' crossing the Old Mayfield Road
centerline Station 15+13.92 to the point of beginning.
The above parcel contains 0.264 acres of 11519 square feet.
PARCEL NO. 8A
Beginning at a point 20' right of Berger Road Station 58+57.15, being 834.26'
with the centerline in a westerly direction from the intersection of the
centerline of Berger Road and Old Mayfield Road; thence N 320 35' 00" W for
20.0' to a point 40' right of Station 58+57.15; thence N 570 25' 00" E for
25.93' to a point 40' right of Station 58+31.22; thence along an arc to the
right for 174.30'; having a radius of 756.2; the chord of which is N 640 1'
12" E for 173.92' to a point 40' right of Station 56+66.14; thence S 570 25'
00" W 198.70' to the point of beginning.
The above parcel contains 0.065 acres or 2,828 square feet.
It is the specific intention of the grantors herein to convey, in fee simple,
the property described above and designated as parcels no. 8 and 8A, con-
taining a total of 0.329 acres of 14,347 square feet.
The acquisition of the right-of-way of this project was authorized by the
Kentucky Bureau of Highways Official Order No. 87464. The control of access
on this project and access to the remaining property of the first party shall
be by permit, as required and set forth in Section 5 of the Kentucky
Administrative Regulations (603 KAR 5:010).
Being a portion of the same tract of land conveyed to the party of the first
part by L. Burger, Et Ux, recorded in Deed Book No. 603, Page 737, dated March
24, 1978.
SECTION 2. The City Treasurer is hereby authorized to transfer to the Paxton Park
Golf Commission, the sum of $7,000.00 when said amount is received by the City of Paducah for
sale of said property.
SECTION 3. That the Mayor be authorized and directed to enter into a deed of
conveyance for the aforesaid purpose.
SECTION 4. This ordinance shall be read on two separate days and will be effective
upon publication of title and a certified summary thereof.
