HomeMy WebLinkAbout85-12-2774ORDINANCE NO. 85-12-2774 AN ORDINANCE AMENDING SECTION 2-22, "SICK LEAVE", OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY SECTION 1. That Section 2-11, "Sick Leave", be amended to read as follows: "Sec. 2-22. Sick Leave. "(a) Each employee of the city regularly employed on a full-time basis shall be entitled to sick leave with pay, and each employee shall be entitled to accrue sick leave time up to and including a total of one hundred twenty (120) working days. The accrual of sick leave shall be at the rate of one and one-half (1 1/2) working days for each month of service up to a total of one hundred twenty (120) days. No sick leave shall be credited to any employee until such time as he has worked for the city for six (6) consecutive months, after which time sick leave shall be credited from the date of employment. A month in which a salaried employee is paid for fifteen (15) days or more, and a daily or hourly employee is paid 1,ar twelve (12) days or more, or a member of a platoon in the fire department is paid for five (5) twenty -four-hour periods or more, shall be considered a month of service. Any employee granted a leave of absence for any purpose shall continue to accrue sick leave at the rate prescribed in this section during such absence. When an employee retires or dies, he or his surviving spouse or his designated beneficiary shall be paid an amount equivalent to one day's regular pay for all sick days he has accumulated over fifty (50) days at the time of such retirement or death". "(a.l) Employees who have accumulated one hundred twenty (120) days in the above described manner may continue to accumulate an additional thirty (30) days of sick leave at the rate of one and one-half (1 1/2) days per month of employment up to a total of one hundred fifty (150) days. These additional thirty (30) days'are not subject to inclusion in calculations for purpose of retirement pay or death benefits". (b) An employee eligible for sick leave with pay shall be granted such leave for the following reasons only: (1) Personal illness or physical incapacity resulting from causes beyond the employee's control. (2) The illness of a member of the employee's household, the employee's parents, or children, whether or not said parents or children are a member of the employee's household, that require the employee's personal care and attendance. (3) Enforced quarantine of the employee in accordance with community health regulations. (4) The death of a member of the employee's immediate family; provided however, the employee will be excused from work for a period of three (3) days only beginning with the day of death and ending with the day after the funeral, and the employee may be paid for such three (3) days by taking credit for accumulated sick leave, but any additional time taken during such period shall be deducted from accrued vacation, or as may be authorized for advanced vacation. "Family" in this instance shall include the spouse and all lineal and lateral relations of the employee or spouse, any-_de-aendent o€_ -:the :,employee or any guardian or blood relative which had the primary responsibility of raising the employee or spouse during childhood, or any son-in-law or daughter-in-law. (c) An employee on sick leave shall inform his department head of the fact and the reason therefor as soon as possible, .and -failure to do `.so within the first _day of absence may, at the discretion of the City Manager, be cause for denial of sick leave with pay for the period of absence. 473 :y V 474 (d) An employee receiving sick leave with pay who simultaneously receives any compensation through a sick benefit plan financed in whole or in part by the city shall receive, for the duration of such compensation, only that portion of his regular salary which will, together with such compensation, equal his regular salary. (e) Sick leave with pay in excess of three (3) consecutive working days for any reason shall be granted only after presentation of a written statement by a licensed physician certifying that the employee was unable to perform the duties of his position. Such statements shall accompany payrolls -submitted to the city treasurer. , (f) In special cases, with individual employees, where the department head feels it is necessary to avoid abuse of the sick leave provisions, the department head may, with the approval of the City Manager, require that employee to submit a written statement by a licensed physician for any absence. The employee will be notified in advance that he will be required to submit such a statement when he is absent on sick leave. (g) In unusual circumstances, and with the approval of the department head and the City Manager, sick leave may be taken in advance of accrual up to a maximum of thirty (30) working days; provided that any employee separated from city employment who has been granted sick leave that is unaccrued at the time of such separation shall reimburse the City for all salary paid in connection with such unaccrued leave and, if possible, for this purpose a deduction shall be made from the employee's final payroll check. (h) Members of a platoon in the Paducah Fire Department working. :shifts .of twenty-four (24) hours on duty and forty -.eight (48) hours off duty shall be charged with two (2) day's sick leave for each twenty -four-hour shift. One day of sick leave will be charged for any excused period of illness up to twelve (12) hours. Compensation for sick leave shall be computed at the member's rate of pay times the hours absent during the pay period, and full credit shall be given for regular and overtime pay as if the member had actually worked his scheduled shift of twenty-four (24) hours on duty and forty-eight (48) hours off duty as required by KRS 95.500. (i) Upon the death of a member of the Fire Department in the line of duty, which is defined as an accidental death that occurs as a result of direct involvement in the act of fire suppression or other related fire-fighter duties and/or responsibilities, all sick time accrued shall be paid to the member's spouse or designated beneficiary. (j) The City agrees to allow fire department personnel to borrow up to fifteen (15), twenty -four-hour shifts of sick time in accordance with the provisions of Paragraph (g) herein. SECTION 2. This ordinance shall be read on two separate days and will become effective upon publication of title and a certified summary thereof.
