ORDINANCE NO. 85-11-2762
AN ORDINANCE APPROVING THE SETTLEMENT OF LITIGATION BETWEEN THE CITY OF PADUCAH
AND CLOVIS L. LOVELACE
WHEREAS, Clovis L. Lovelace filed suit against the City of Paducah in the
United States District Court claiming injuries based on alleged violations of the Equal
\ Employment Opportunity Act; and
�i WHEREAS, the Board of Commissioners finds it would be more expedient on behalf
of the City to settle said claim,with Clovis L. Lovelace, rather -than continue defending
the litigation through trial at the District -Court level and possible appeals; and
WHEREAS, the'City of Paducah does not admit any wrongdoing or liability to Mr.
Lovelace, and any settlement is made strictly on economic considerations.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City Treasurer is authorized to issue a check to Clovis L.
Lovelace in the amount of Three Thousand Five Hundred Dollars ($3,500.00) for complete
satisfaction of all claims Mr. Lovelace has against the City of Paducah or any officer or
employee of the City of Paducah.
SECTION 2. The Corporation Counsel is authorized prepare and execute any and
all papers and documents necessary or advisable in the opinion of the Corporation
Counsel to release the City from any liability to Clovis L. Lovelace.
SECTION 3. In order to implement the Settlement Agreement reached between the
City and Clovis L. Lovelace as practically as possible, an emergency is hereby declared
to exist and this ordinance shall be approved upon one reading and publication of a
certified summary.
