ORDINANCE NO. 85-9-2725
AN ORDINANCE APPROVING THE CLOSING OF A PORTION OF NATCHEZ LANE FOR A DISTANCE OF
APPROXIMATELY 150 FEET
WHEREAS, Jack S. McKinney has requested that the right-of-way known as Natchez Lane
be closed; and
WHEREAS, the Planning Commission reviewed this closing on August 5, 1985, and
passed application to the Board of Commissioners without. a recommendation; and
WHEREAS, the Board of Commissioners finds that this right-of-way is unimproved and
is not needed as a public right-of-way.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The City of Paducah does hereby authorize the closing of a portion of
Natchez Lane for a distance of approximately 150 feet, which is more particularly described
as follows:
That portion of Natchez Lane in the City of Paducah, Kentucky, which
begins at the intersection of Martin Circle and runs in a southerly
direction for a distance of approximately 150 feet to the point where -
Natchez Lane enters Cherokee Highlands Subdivision, and recorded in Plat
Book "D", page 45, McCracken County Clerk's Office.
SECTION 2. The City of Paducah is approving the closing of the right-of-way
contingent upon the adjoining property owners granting to the City a permanent utility
easement on, over and under the right-of-way being closed.
SECTION 3. The Corporation Counsel of the City of Paducah, Kentucky, be, and he is
hereby, authorized, empowered and directed to institute and prosecute, pursuant to KRS
82.405, an action in McCracken Circuit Court for a judgment ordering the closing of the
street described in Section 1 above.
SECTION 4. This ordinance shall be read on two separate days and will be effective
upon publication of title and a certified summary thereof.
