HomeMy WebLinkAbout85-9-2724380 ORDINANCE NO. 85-9-2724 AN ORDINANCE CREATING SECTION 19.160 THROUGH 19.162, PROHIBITING GAMBLING IN PUBLIC PLACES AND REPEALING SECTIONS 19-23 THROUGH 19-26 OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH WHEREAS, Kentucky Revised Statutes make it illegal to promote gambling, conspire to promote gambling, possess gambling records devices, or permitting gambling activity; and WHEREAS, a problem has arisen within the City of Paducah with gambling in public places which is not prohibited by the Kentucky Revised Statutes; and WHEREAS, it is the intent of the Board of Commissioners of the City of Paducah to supplement the Kentucky Revised Statutes and prohibit gambling in public places. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY, AS FOLLOWS: SECTION 1. Definitions. Sec. 19.160 is hereby created to read as follows: 1. Gambling means staking or risking something of value upon the outcome of a contest, game, gaming scheme or gaming device which is based upon an element of chance, in accordance with an agreement or understanding that someone will receive something of value in the event of a certain outcome. 2. Public place is defined as any street, alley, parking lot, or any other unenclosed area visible from road, sidewalk or alley, without the aid of binoculars. SECTION 2. Sec. 19.161 is hereby created to read as follows: "A person is guilty of gambling in a public place when he participates in a gambling activity while in a public place." SECTION 3. Sec. 19.162 is hereby created to read as follows: "Gambling in a public place is a Class B Misdemeanor punishable by confinement in the County Jail for a term not to exceed ninety (90) days and/or a fine of $250.00, or both. SECTION 4. Sec. 19-23 through 19-26 are hereby repealed. SECTION 5. Due to the need for an ordinance to control gambling in public places, an emergency is hereby declared to exist and this ordinance shall be effective immediately upon one reading and publication in full.
