HomeMy WebLinkAbout09/24/04447 SEPTEMBER 28, 2004 At a Regular Meeting of the Board of Commissioners, held in the Commission Chambers at City Hall at 6:00 p.m., Tuesday, September 28, 2004, Mayor Pro Tem Montgomery, presided, and upon call of the roll by the City Clerk, the following answered to their names: Commissioners Coleman, Guess, Smith and Mayor Pro Tem Montgomery (4). Mayor Paxton was absent (1). ADDITIONS/DELETIONS The City Manager informed the Commission that item V (D), "Amend Noise Ordinance" on the agenda would be removed from tonight's agenda. PUBLIC HEARING FOR PROPERTY TAX LEVY Mayor Pro Tem Montgomery opened a public hearing for any public comments regarding the property tax levy. No public comments were made. Mayor Pro Tem Montgomery announced the public hearing was closed. PRESENTATION Principal Jimmy Johnson and Tina Hays, teacher, of Farley Elementary thanked Mrs. Earlie Fugate for volunteering time during school hours to the students. PROCLAMATION STAFFING EMPLOYEE WEEK Mayor Pro Tem Montgomery read a proclamation proclaiming September 27 — October 1, 2004, as "Staffing Employee Week". MINUTES Commissioner Coleman offered motion, seconded by Commissioner Guess, that the reading of the Minutes for September 14, and September 27, 2004, be waived and that the Minutes of said meetings prepared by the City Clerk be approved as written. Adopted on call of the roll, yeas, Commissioners Coleman, Guess, Smith and Mayor Pro Tem Montgomery (4). RESOLUTION GREAT AMERICAN MAIN STREET AWARDS COMPETITION Mayor Pro Tem Montgomery offered motion, seconded by Commissioner Guess, that the Board of Commissioners adopt a resolution supporting the entry of Paducah Main Street into the Great American Main Street Awards competition. Adopted on call of the roll, yeas, Commissioners Coleman, Guess, Smith and Mayor Pro Tem Montgomery (4). MUNICIPAL ORDERS CREATE POSITION IN FINANCE DEPARTMENT Commissioner Smith offered motion, seconded by Commissioner Coleman, that a Municipal Order entitled, "A MUNICIPAL ORDER AMENDING TABLE 2, CLASSIFICATIONS/ PAY SCHEDULE, FOR NON -CIVIL SERVICE, POLICE AND FIRE EMPLOYEES, FOR FINANCE DEPARTMENT" be adopted. AUTHORIZE AFFORDABLE HOUSING TRUST FUND FOR CHRISTMAS IN APRIL GRANT Commissioner Guess offered motion, seconded by Commissioner Coleman, that a Municipal Order entitled, "A MUNICIPAL ORDER AUTHORIZING THE APPLICATION FOR A GRANT IN THE AMOUNT OF $84,000.00, FROM THE KENTUCKY HOUSING CORPORATION FOR AN AFFORDABLE HOUSING TRUST FUND GRANT FOR THE CHRISTMAS IN APRIL PROGRAM," be adopted. M.O.#1097; BK 5; PG ORDINANCES — ADOPTION SETTING TAX LEVIES: AD VALOREM PROPERTIES Commissioner Smith offered motion, seconded by Commissioner Coleman, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE FIXING THE LEVIES AND RATES OF TAXATION ON ALL PROPERTY IN THE CITY OF PADUCAH, KENTUCKY, SUBJECT TO TAXATION FOR MUNICIPAL PURPOSES AND FOR SCHOOL PURPOSES FOR THE PERIOD FROM JULY 1, 2004, THROUGH JUNE 30, 2005, WITH THE PURPOSES OF SAID TAXES HEREUNDER DEFINED". In the case of all other tax bills, payment shall be in accordance with the following provisions: ■ The first half payment shall be due on November 1, 2004, and shall be payable without penalty and interest until November 30, 2004. ■ The second half payment shall be due on February 1, 2005, and shall be payable without penalty and interest until February 28, 2005. ORD.#2004-9-6871; BK 30; PG PAXTON PARK FUNDING Commissioner Coleman offered motion, seconded by Commissioner Guess, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE A CONTRACT WITH PAXTON PARK GOLF BOARD FOR SPECIFIC SERVICES AND AUTHORIZE THE FINANCE DIRECTOR TO TRANSFER FUNDS TO SAID BOARD." This ordinance is summarized as follows: The City of Paducah authorizes and directs the Mayor to execute a contract with Paxton Park Golf Board in the amount of $35,000 for specific services for the Paducah area and authorize the Finance Director to transfer said funds from Commission Contingency. ORD.#2004-9-6872; BK 30; PG NOBLE PARK TENNIS COURT RESURFACING Commissioner Guess offered motion, seconded by Commissioner Coleman, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE ACCEPTING THE BID OF TENNI-TRAC SPORTS SURFACES FOR THE RESURFACING OF THE NOBLE PARK TENNIS COURTS AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME." This ordinance is summarized as follows: That the City of Paducah accepts the bid of Tenni-Trac Sports Surfaces in the amount of $22,000, for the resurfacing of the Noble Park tennis courts and authorize the Mayor to execute a contract for same. ORD.#2004-9-6873; BK 30; PG AMEND ORDINANCE FOR VEHICLES DRAWN BY ANIMALS Commissioner Coleman offered motion, seconded by Commissioner Guess, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING CHAPTER 122, VEHICLES FOR HIRE, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY." This ordinance is summarized as follows: The City,of Paducah hereby amends Chapter 122 to require routes of animal -drawn vehicles be approved by the Traffic Commission; that each carriage is to have a separate and unique identification number displayed on the rear of the vehicle, and to require that each operator obtain either a Downtown Horse Carriage Tour Permit or a Contract Operating Permit. The procedure for bidding on such permits as well as standards and requirements for carriage companies who win such bids is established. ORD.#2004-9-6874; BK 30; PG 450 SEPTEMBER 28, 2004 ORDINANCES — INTRODUCTION APPROVE PURCHASE OF K-9 DOG FOR POLICE DEPARTMENT Commissioner Guess offered motion, seconded by Commissioner Coleman, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING THE FINANCE DIRECTOR TO PURCHASE A K-9 DOG FOR THE PADUCAH POLICE DEPARTMENT." This ordinance is summarized as follows: The City of Paducah hereby authorizes the Finance Director to pay to Vohne Liche Kennels the sum of $10,454.60 for the purchase of a K-9 dog and handler training for the Paducah Police Department. AMEND PLANNED OFFICE PARK REGULATIONS Commissioner Smith offered motion, seconded by Commissioner Coleman, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING SEC. 126-117, PLANNED OFFICE PARK, POP, OF CHAPTER 126, ZONING, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY." This ordinance is summarized as follows: That Sec. 126-117, Planned Office Park, POP, of Chapter 126, Zoning, of the Code of Ordinances of the City of Paducah, Kentucky, is amending the regulations to allow for a larger variety of principal permitted uses. AMEND FY2004-2005 BUDGET Commissioner Coleman offered motion, seconded by Commissioner Guess, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING ORDINANCE NO. 2004-6-6827, ENTITLED, "AN ORDINANCE ADOPTING THE CITY OF PADUCAH, KENTUCKY, ANNUAL BUDGET FOR THE FISCAL YEAR JULY 1, 2004, THROUGH JUNE 30, 2005, BY ESTIMATING REVENUES AND RESOURCES AND APPROPRIATING FUNDS FOR THE OPERATION OF CITY GOVERNMENT." This ordinance is summarized as follows: Amend the annual budget for the fiscal year beginning July 1, 2004, and ending June 30, 2005, by a supplemental appropriation in the amount of $30,500 to the Finance Department and increasing the General Fund revenues by the same amount. AUTHORIZE CONTRACT FOR OPERATION OF GOVERNMENTAL ACCESS CHANNEL Commissioner Guess offered motion, seconded by Commissioner Coleman, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AN AGREEMENT FOR OPERATION OF THE GOVERNMENT ACCESS CHANNEL 11 AND OTHER RELATED SERVICES." This ordinance is summarized as follows: That the Mayor is herebyauthorized and directed to execute a contract between the City of Paducah, Paducah Cable Authority, West Kentucky Community & Technical College and Paducah Junior College in an amount not to exceed $60,000.00 for operation of the Government Channel 11 and related services for the City. CITY MANAGER REPORT • Judge Orazine has issued a "No Burn Order" for McCracken County until we get 2" of rain. • Paducah Cable Authority is moving forward with franchise negotiations.
